C. Approval of a secondary dwelling unit shall not be deemed to be a division of land <br />for purposes of Government Code Section 66410 et seq. or Title VII of the <br />Municipal Code, nor shall this approval in accord with the Article entitle the <br />applicant to: <br />1. Such a division of land; or <br />2. To have each of the two (2) dwelling units on the parcel separately assessed <br />for property tax purposes. <br />D. Within thirty (30) days of this approval, the applicant shall record with the <br />Alameda County Recorder a Notice of Occupancy Restriction that states that the <br />main dwelling or secondary dwelling on the property will be owner-occupied and <br />eli 'ble for a homeowner's exem tion for state tax a oses ursuant to onin <br />gl Z <br />p p <br />rP p g <br />Code Section 2-576(E}(2)(g). <br />E. As shown on the approved site plan, a minimum of three off-street parking spaces <br />shall be maintained on the property (two spaces inside the proposed four-car <br />garage and one space in the driveway). <br />III. SITE DEVELOPMENT REQUIREMENTS <br />A. Prior to issuance of building permits, a final landscape and irrigation plan shall be <br />submitted for any new landscaping on the site. At a minimum, the planting plans shall <br />be required to have trees, with a minimum size of 15 gallons. The landscape plans shall <br />also include a pallet of flowering shrubs or plants that have colorful foliage and turf <br />and/or ground cover planting. The minimum size for the shrubs would be five gallons <br />and the ground cover would be one-gallon or from flats with the necessary spacing to <br />cover the planter areas in a growing season. Any new landscaping shall comply with the <br />City's Water Efficient Landscaping Requirements, per Resolution 92-312. <br />B. Prior to issuance of a certificate of occupancy, the applicant shall completely install all <br />the landscaping and irrigation approved on the final landscaping and irrigation plan <br />noted above. <br />C. Any above ground back-flow preventors shall be adequately screened to the satisfaction <br />of the Community Development Director. <br />D. All landscaping improvements shall be maintained in a healthy growing condition at all <br />times. The landscaped areas shall be irrigated by an automatic sprinkler system designed <br />to reduce water usage. The type, nature and amount of landscaping shall conform to the <br />approved final landscape and irrigation plan at all times. <br />E. Any new hardscape proposed for an expanded driveway approach shall be included in <br />the landscape plan for review and approval by the Community Development Director. <br />Conditions of Approval June 17, 2008 <br />PLN2008-00017 Page 4 of 8 <br />
