CONDITIONS OF APPROVAL <br />PLN2008-00042 -1300 Bancroft Avenue <br />D. Nguyen (Applicant) and B. Warhurst (Property Owner) <br />I. COMPLIANCE WITH APPROVED PLANS <br />A. The property owner shall comply with Exhibits A through C, dated November 6, <br />2008, except as hereinafter modified. (Copies of Exhibits are on file in the <br />Community Development Department, 83S East 14th Street, San Leandro, <br />California). <br />Exhibit A -Site Plan <br />Exhibit B - Second Story Plan <br />Exhibit C - Floor Plan <br />B. The applicant and/or property owner shall be responsible for assuring that any <br />successor in interest who assumes responsibility far this conditional use permit <br />approval is informed of its terms and conditions. <br />IL PERMITTED USE <br />A. This conditional use permit approval allows for chair massage business to operate <br />within an existing medical offices building. The hours of operation for the <br />business shall be 9:30 am to 7:30 pm, Monday to Saturday and 10:00 am to 7:00 <br />pm on Sunday; 1300 Bancroft Avenue, Suite 201; Alameda County Assessor's <br />Parcel Number 77-524-12-4. <br />B. This use permit allows for a total of no more than nine (9) massage chairs within the <br />unit identified as Suite 201. Use of additional space in this building for massage <br />therapy, whether it is an expansion of this business or a new massage therapy <br />business, shall be required to go through a separate Conditional Use Permit process. <br />C. All employees of this business or contractors with the business involved in massage <br />of clients shall be Certified Massage Therapists (CMTs) and shall obtain individual <br />massage therapist permits in compliance with Municipal Code Section 4-23-400. <br />D. All clients shall be seen at the business location at 1300 Bancroft Avenue; out-call <br />massage visits are prohibited by Municipal Code Section 4-23-540. <br />E. Any complaints regarding this business maybe grounds for a review hearing by the <br />Board of Zoning Adjustments or revocation of the business license, subject to a <br />decision by the Community Development Director and the Police Chief. <br />Conditions of Approval December 4, 2008 <br />PLN2008-00042 Page 3 of 4 <br />
