CONDITIONS OF APPROVAL <br />PLN2007-00019 - 39 Dutton Avenue <br />(Alameda County Assessor's Parcel Number 76-42Q-17) <br />Gabriella Ghai (Applicant and Property Owner) <br />I. COMPLIANCE WITH APPROVED PLANS <br />A. The applicant shall comply with Exhibits A through J, dated May 1, 2008, except as <br />hereinafter modified. The applicant and/or property owner shall be responsible for assuring that any successor <br />in interest who assumes responsibility for this zoning approval is informed of its terms <br />and conditions. <br />C. Construction shall commence within one (1) year following Board of Zoning <br />Adjustments approval of the Conditional Use Permit and Site Plan Review, and shall <br />be substantially completed one year after commencement of construction. For the <br />purpose of compliance with this condition, commencement of construction shall be <br />defined as the pouring or construction of a substantial portion of the building <br />foundation structures. Pursuant to Zoning Code Section 5-2218, this approval shall <br />lapse on May 1, 2009 unless a) a building permit has been issued, coupled with diligent <br />progress evidencing a good faith intent to commence the intended use, or b) a written <br />request for cone-year extension of the use permit is approved by the Zoning <br />Enforcement Official. <br />II. USE RESTRICTIONS <br />A. This conditional use permit and site plan review approves construction of an addition <br />to the existing single-story dwelling and a one and two-story additional unit attached <br />to the rear and to the top of the existing dwelling, thereby creating atwo-family <br />dwelling (duplex) at 39 Dutton Avenue. The existing home (1,180 square foot single- <br />story single-family home) would be enlarged 245 square feet and improved to a three <br />bedroom and two bathroom unit. The rear unit would be two-story totaling 1,770 <br />square feet (386 square foot ground floor and 1,384 square foot second floor) and <br />would include three bedrooms and three bathrooms.
