CONDITIONS OF APPROVAL <br />PLN2007-00003 <br />1188 Montague Avenue <br />Santos Agency, Inc. (Applicant and Property Owner) <br />L COMPLIANCE WITH APPROVED PLANS <br />A. The property owner shall comply with Exhibits A through F, attached to the staff <br />report dated June 7, 2007, except as hereinafter modified. (Copies of Exhibits A <br />through G are on file in the Community Development Department, 835 East 14th <br />Street, San Leandro, California). <br />Exhibit A -Existing Site Plan <br />Exhibit B - Proposed Site Plan <br />Exhibit C - Existing Floor Plan <br />Exhibit D -Proposed Floor Plan <br />Exhibit E - Proposed Restaurant Layout <br />Exhibit F - Elevations <br />B. The applicant and/or property owner shall be responsible for assuring that any <br />successor in interest who assumes responsibility for this zoning approval is <br />informed of its terms and conditions. Construction shall commence within one (1) <br />year following Board of Zoning Adjustments approval and shall be substantially <br />completed one (1) year thereafter. For the purpose of compliance with this <br />condition, commencement of construction shall be defined as the pouring or <br />construction of a substantial portion of the building foundation. <br />II. PERMITTED USE <br />A. This conditional use permit allows for the establishment of an approximately <br />1,890 square-foot Small Scale Fast Food Establishment within an existing <br />warehouse at 1188 Montague Avenue; Alameda County Assessor's Parcel <br />Number 77A-648-6-36. Any change to the site plan or modification of expansion <br />of the restaurant area or outdoor seating area shall be subject shall be subject to <br />the review of the Community Development Director, who may approve it <br />administratively or direct it to the Board of Zoning Adjustments for a formal <br />public hearing as a modification to the use permit. <br />B. The hours of the operation for the restaurant shall be 11:30 a.m. to 8 p.m. Tuesday <br />thru Saturday, and 11:30 a.m. to 7 p.m. on Sundays, and closed on Mondays. Any <br />proposed changes to the hours of operation for the restaurant shall be subject shall <br />be subject to the review of the Community Development Director, who may <br />approve it administratively or direct it to the Board of Zoning Adjustments for a <br />formal public hearing as a modification to the use permit. <br />Agreement to Conditions June 7, 2007 <br />PLN2007-00003 Page 3 of 10 <br />
