(2993) <br />Councilmember Souza asked how the number of employees would be determined for <br />the purpose of weighting the protest vote. Community Development Director Luke <br />Sims indicated that the number of employees was based on the employee count that <br />each business reports on its business license. He noted that generally, businesses report <br />full-time equivalents (FTEs) rather than part-time employees. <br />Councilmember Souza requested a change to the wording in Section 4 of the resolution, <br />which currently reads, "...nonprofit businesses falling under Internal Revenue Code <br />section 501(c)(3) do not benefit from the proposed assessment and shall not be <br />assessed." She pointed out that the Davis Street Family Resource Center benefits from <br />the assessment. <br />Councihnember Souza stated that, at the Facilities and Transportation Committee <br />meeting, she had expressed concern regarding who would be authorized to sign the <br />protest card. She suggested that the "highest ranking official at that location" be <br />authorized to sign the protest. Mr. Sims reported that, based on the Committee's <br />comments, the card has been modified to broaden the list of authorized signers. <br />- Adopted with revision to Section 4 of the resolution as follows: "...nonprofit <br />businesses falling under Internal Revenue Code section 501(c)(3) de--ne~l~ene€tt <br />shall not be assessed." <br />M/S/C Prola and Souza. Reports on Intergovernmental Agencies <br />Councilmember Prola reported on the January 21 meeting of the Airport Noise Forum, <br />including a report on RAPC, the Regional Airport Planning Committee; and Fed Ex <br />727s, which should be phased out by 2012. He commented on the complaints he has <br />received from residents about noise from the Fed Ex nighttime departures. <br />
