Discussion Regarding 2008 Alameda County State of Tobacco Control Grades <br />The City's "report card" related to tobacco control was brought to the City Council's attention <br />by the American Lung Association and several other agencies at the January 20, 2009 City <br />Council meeting. Community Relations Representative Kathy Ornelas reported on the City's <br />history of tobacco control, noting that most of the City's local laws related to tobacco control <br />have been superseded by more restrictive state law. She provided the Committee with copies <br />of California Labor Code section 6404.5, with which most businesses currently comply. All <br />complaints related to smoking violations are referred to Ms. Ornelas as the Community <br />Relations Representative for enforcement, except for those at bars or cocktail lounges, which <br />the Police Department handles. Ms. Ornelas stated that the last complaint of smoking in the <br />workplace she received was in 2006. She indicated that the City's Municipal Code should be <br />amended to remove the sections related to tobacco control that have been superseded by the <br />California Labor Code. Ms. Ornelas provided a handout of the sections of the Municipal Code <br />related to smoking that are not covered in state law, including the ability of a business owner to <br />designate an entire facility as non-smoking. <br />
