MINUTES Page 3 <br />City of San Leandro City Council and San Leandro Redevelopment Agency Joint Meeting-March 16, 2009 <br />Approval of the FY 2009-2010 Annual Action Plan and HUD Section 108 Loan <br />Guarantee Application for the Senior Center. (2972) <br />The City Council directed staff to publish the Draft FY 2009-2010 Annual <br />Action Plan and Draft HUD Section 108 Loan Guarantee Application for <br />the Senior Center fora 30-day comment period (March 20 - Apri120, 2009) <br />and to set a public hearing for Apri120, 2009 to consider final approval of <br />the FY 2009-2010 Annual Action Plan and HUD Section 108 Loan <br />Guarantee Application for the Senior Center. <br />M/S/C Reed and Prola. Ayes: 5; Noes: 0; Absent: 2 (Gregory and Starosciak) <br />B. Matter of Consideration of an Ordinance Re-Establishing the West San Leandro <br />Shuttle Business Improvement District (BID) (allows the City Council, at its <br />discretion, to reestablish a slightly modified West San Leandro Shuttle BID provided <br />less than 50% protest vote is received from the affected business owners). <br />This being the time and place for the Public Hearing on the above matter, City Manager <br />Hollister gave background on the item and introduced Business Development Manager <br />Cynthia Battenberg. Ms. Battenberg informed the Council that 39 protest ballots were <br />received, and one ballot was considered invalid. The protest vote is 9%. She indicated <br />that when the protest vote is less than 50%, the City has the right to establish the BID. <br />The Hearing was then opened to the public. <br />John Johnson, San Leandro Chamber of Commerce, addressed the City Council, <br />expressing support for LINKS and its benefits to the employees on the west side. Mr. <br />Johnson commented that LINKS provides an opportunity for existing and new <br />employers to encourage the use of public transportation. <br />Gordon Galvan, San Leandro Transportation Management Organization, <br />addressed the City Council, commenting that LINKS is in its eighth year of operation, <br />and continues to meet its goals and objectives. Mr. Galvan requested that the City <br />Council continue the BID for another five years. <br />There being no further comments from the public, and without objection, the Public <br />Hearing was closed. <br />A motion was made by Councilmember Prola, seconded by Councihnember Reed, to <br />pass to print the proposed ordinance. <br />Councilmember Souza requested discussion on the matter. She inquired about Section <br />2-15-090 of the proposed ordinance regarding the effective period of assessment. City <br />Attorney Jayne Williams explained that State law provides for disestablishment of an <br />assessment district sooner than as established in the enabling legislation. <br />Councilmember Souza commented that Redevelopment funds should not be considered <br />as a sustainable funding mechanism for LINKS.
