MINUTES Page 3 City of San Leandro City Council and San Leandro Redevelopment Agency Joint Meeting-March 16, 2009 Approval of the FY 2009-2010 Annual Action Plan and HUD Section 108 Loan Guarantee Application for the Senior Center. (2972) The City Council directed staff to publish the Draft FY 2009-2010 Annual Action Plan and Draft HUD Section 108 Loan Guarantee Application for the Senior Center fora 30-day comment period (March 20 - Apri120, 2009) and to set a public hearing for Apri120, 2009 to consider final approval of the FY 2009-2010 Annual Action Plan and HUD Section 108 Loan Guarantee Application for the Senior Center. M/S/C Reed and Prola. Ayes: 5; Noes: 0; Absent: 2 (Gregory and Starosciak) B. Matter of Consideration of an Ordinance Re-Establishing the West San Leandro Shuttle Business Improvement District (BID) (allows the City Council, at its discretion, to reestablish a slightly modified West San Leandro Shuttle BID provided less than 50% protest vote is received from the affected business owners). This being the time and place for the Public Hearing on the above matter, City Manager Hollister gave background on the item and introduced Business Development Manager Cynthia Battenberg. Ms. Battenberg informed the Council that 39 protest ballots were received, and one ballot was considered invalid. The protest vote is 9%. She indicated that when the protest vote is less than 50%, the City has the right to establish the BID. The Hearing was then opened to the public. John Johnson, San Leandro Chamber of Commerce, addressed the City Council, expressing support for LINKS and its benefits to the employees on the west side. Mr. Johnson commented that LINKS provides an opportunity for existing and new employers to encourage the use of public transportation. Gordon Galvan, San Leandro Transportation Management Organization, addressed the City Council, commenting that LINKS is in its eighth year of operation, and continues to meet its goals and objectives. Mr. Galvan requested that the City Council continue the BID for another five years. There being no further comments from the public, and without objection, the Public Hearing was closed. A motion was made by Councilmember Prola, seconded by Councihnember Reed, to pass to print the proposed ordinance. Councilmember Souza requested discussion on the matter. She inquired about Section 2-15-090 of the proposed ordinance regarding the effective period of assessment. City Attorney Jayne Williams explained that State law provides for disestablishment of an assessment district sooner than as established in the enabling legislation.
