IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2009- <br />RESOLUTION AUTHORIZING THE CITY MANAGER TO SUBMIT A U.S. <br />DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT (HUD) SECTION 108 <br />LOAN APPLICATION TO FINANCE THE NEW SENIOR CENTER CONSTRUCTION AND <br />EXECUTE DOCUMENTS TO IMPLEMENT THE APPLICATION <br />RPritalc <br />WHEREAS, the City of San Leandro desires to submit a Section 108 loan application for <br />$2.5 million dollars to HUD for assistance with financing construction of the new senior center; <br />and <br />WHEREAS, the City possesses the legal authority to submit an application for assistance <br />and will use the loan funds in accordance with all legal requirements and; <br />WHEREAS, the City must take certain actions in accordance with Title 24 of the Code of <br />Federal Regulations Sections 5'70.704(b)(8)(ii)(A) and (B) before making an application for <br />funding. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />That in accordance with 24 CFR Section 570.704(b)(8)(ii)(A) the City Manager or his <br />designee is authorized to submit the application and amendments thereto and all understandings <br />and assurances contained therein and authorizes the City Manager or his designee to act in <br />connection with the application to provide additional information as may be required; and <br />That in accordance with 24 CFR Section 570.704(b)(8)(ii)(B) the City Manager is <br />authorized to execute such documents as maybe required in order to implement the application <br />and issue debt obligations pursuant thereto. <br />1 <br />
