IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION N0.2009-055 (2874) <br />RESOLUTION OF INTENTION CALLING FOR A PUBLIC HEARING TO AMEND THE <br />EXISTING UNDERGROUND DISTRICT ON EAST 14~ STREET FROM 150 AVENUE <br />TO LILLIAN AVENUE TO INCLUDE THE SEGMENT FROM LILLIAN AVENUE TO <br />THORNTON STREET/MAUD AVENUE, AND SETTING THE DATE FOR A PUBLIC <br />HEARING ON MAY 18, 2009 <br />Recitals <br />The City Council of the City of San Leandro does RESOLVE as follows: <br />Pursuant to the provisions of Section 5-3-200 of the San Leandro Municipal Code, the City <br />Council hereby calls a public hearing to ascertain whether or not the public necessity, health or <br />safety require the removal of poles and overhead wires and associated overhead structures, and the <br />underground installation of wires and facilities for supplying electric, communication, television, <br />or similar associated service, in the following areas: <br />A. East 14~' Street, from a line parallel with and approximately along the southerly right- <br />of-way line of Thornton Street and Maud Avenue to the southerly right-of--way line of <br />Lillian Avenue, as more specifically set forth in Attachment 1. Said areas being <br />considered for inclusion in an existing underground district on East 14~' Street. <br />Said hearing shall be held on Monday, the 18~` day of May 2009, at the hour of 7:00 p.m., <br />in the Council Chambers of the San Leandro City Council, in San Leandro City Hall, 835 East 14~' <br />Street, San Leandro, California. Any and all persons having any objections to the establishment of <br />the underground district may appear before said Council and show cause why the establishment of <br />said underground district should not be ordered. Objections to the establishment of the proposed <br />underground district may be filed in writing with the City Clerk at any time not later than the hour <br />set for said hearing by any person having any interest in any land upon which said undergrounding <br />district is proposed to be established. <br />Notice of Exemption is being reviewed and will be filed by the Community Development <br />Department. <br />The City Clerk shall cause this Public Hearing Notice to be published once a week for at <br />least two successive weeks prior to the date of public hearing stated herein. The first publication <br />shall be no later than May 4, 2009. Said Public Hearing Notice shall be posted conspicuously <br />along the line of the street or easement proposed to be undergrounded at least two weeks before the <br />date set for hearing. Such Public Hearing Notice shall be posted not more than three hundred (300) <br />feet apart, but at least three (3) shall be posted. <br />
