ARTICLE I <br />PLAN AND TRUST INFORMATION <br />1.1 Plan Name. <br />The name of the Plan adopted by the Employer is set forth in Section A.1.2 of the Adoption <br />Agreement. <br />1.2 Effective Date. <br />The Plan is effective as of the date set forth in Section A.1.3 of the Adoption Agreement. If as <br />stated in the Adoption Agreement, this Plan is a restatement of an existing plan, the effective <br />date of the restatement is set forth in the Adoption Agreement. <br />1.3 Plan Year. <br />The Plan Year shall be the consecutive twelve-month period beginning on January 1 and ending <br />on December 31. <br />ARTICLE II <br />EMPLOYER INFORMATION <br />2.1 Employer. <br />The name and address of the Employer sponsoring this Plan (the "Employer") are as set forth in <br />Section A.2.1 of the Adoption Agreement. The Adoption Agreement can only be used by a <br />governmental agency that is a state, a political subdivision of a state, or an entity the income of <br />which is excludible from gross income under Section 115 of the Code to establish a plan. <br />ARTICLE III <br />ELIGIBLE EMPLOYEES <br />3.1 Eligible Employees <br />Each employee of the Employer who is or becomes eligible for post-retirement health care and <br />welfare benefits as specified in such Employer's applicable policies andJor applicable collective <br />bargaining agreements shall become an Eligible Employee hereunder. Dependents of an Eligible <br />Employee shall be entitled to benefits under the Plan after the termination of such Eligible <br />Employee's employment with the Employer (the "Eligible Dependents") to the extent so <br />provided in the applicable policies and/or collective bargaining agreement of the Employer. <br />rrs~:6soo~9.s -2- <br />
