3.2 Termination of Eligible Emplovee or Eligible Dependent Status <br />An Eligible Employee or Eligible Dependent shall cease to be an Eligible Employee or Eligible <br />Dependent as specified in the Employer's applicable policies and/or applicable collective <br />bargaining agreements. <br />ARTICLE IV <br />CONTRIBUTIONS <br />4.1 Amount of Member Agency Contributions <br />Eligible Employees and Eligible Dependents are not permitted to make contributions to the <br />Trust, provided however, that nothing herein shall be deemed to (i) prevent the Employer from <br />imposing a charge (including, without limitation, a payroll deduction) for coverage under the <br />Plan, or (ii) prevent the Employer from depositing the proceeds of any such charge to the Trust <br />(provided that such deposit shall be considered an Employer contribution and shall not be <br />segregated within Employer's Agency Account from any other Employer contributions). Each <br />Employer shall from time-to-time contribute to its Agency Account an amount determined by <br />such Employer in its sole discretion. Such amount may, but need not, equal such Employer's <br />"annual required contribution" ("ARC") as determined in accordance with GASB45. <br />4.2 Administrative Expenses <br />The Employer may make contributions to its Agency Account sufficient to defray all or part of <br />the expenses of administering the Plan or may pay such expenses directly. <br />4.3 Allocation of Administrative Expenses <br />If the Employer chooses not to directly pay the expenses of administering this Plan, such <br />expenses shall be charged against the Agency Account for such Employer. <br />4.4 Reversions <br />The Employer shall have the right to a return of contributions from this Plan only if the <br />conditions for such return set forth in the Trust Agreement are satisfied. <br />NB 1:6800?9.5 -3- <br />
