Hollister Executive Director RESOLUTION ADDING TITLE 26, CHAPTER 5 TO THE SAN LEANDRO ADMINISTRATNE CODE, AUTHORIZING THE REDEVELOPMENT AGENCY EXECUTNE DIRECTOR AND AGENCY SECRETARY TO ACCEPT DEEDS AND EASEMENTS SUMMARY AND RECOMMENDATION The proposed resolution would add Section 26.5.140 to the San Leandro Administrative Code, authorizing the Redevelopment Agency Executive Director and Agency Secretary to accept deeds and grants conveying an interest in or easement upon real property to the San Leandro Redevelopment Agency. Staff recommends the Agency adopt the resolution. BACKGROUND Prior to allowing the recordation of a deed or grant conveying any interest in or easement upon real estate to a public entity, the County Recorder must ensure that the consent of the grantee has been obtained. California Government Code Section 27281 allows a political corporation or governmental agency, by a general resolution, to authorize one or more officers or agents to accept and consent to deeds and grants conveying an interest in or easement upon real property. Since 1983, the City Council has authorized the City Clerk to accept deeds or grants conveying an interest in or easement upon real property to the City of San Leandro. Staff recommends that the Agency approve similar authorization for the Executive Director and Agency Secretary. Current Redevelopment Agency Policy In the absence of a general resolution, acceptance of a deed or grant conveying an interest in or easement upon real property must be made by formal action of the Agency Board.
