IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION N0.2009-065 (2874) RESOLUTION AMENDING THE EXISTING UTILITY UNDERGROUND DISTRICT ON EAST 14TH STREET FROM 150TH AVENUE TO LILLIAN AVENUE TO INCLUDE THE SEGMENT FROM LILLIAN AVENUE TO THORNTON STREET/MAUD AVENUE Recitals Pursuant to a resolution of this Council and notice duly given, a public hearing on the matter of removal of poles, overhead wires and associated overhead structures from the hereinafter-described areas was held on May 18, 2009. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: That this Council hereby determines that such removal will avoid an unusually heavy concentration of overhead distribution facilities, that the streets in the hereinafter described areas are extensively used by the general public and carry a heavy volume of pedestrian and vehicular traffic, and be it further RESOLVED, THAT THIS Council hereby determines that the public necessity, health and safety require the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, cable, or similar associated service, in the following areas: A. East 14~` Street, from a line parallel with and approximately along the southerly right-of--way line of Thornton Street and Maud Avenue to the southerly right-of- way line of Lillian Avenue; B. Containing parcels of land identified by Assessor's Parcel Number listed in Attachment 1 inclusive; and be it further RESOLVED that pursuant to Title V, Chapter 3 of the San Leandro Municipal Code, that this Council hereby orders such removal and the installation of such underground facilities as may be occasioned thereby as follows: 1. Installation by property owners of facilities necessary to receive service no later than February 1, 2013. 2. Removal of poles, overhead wires and associated structures no later than July 1, 2013; and it is further
