"` »~~-!'2009, is <br />entered into by and between the REDEVELOPMENT AGENCY OF TH CITY OF SAN <br />LEANDRO, a public agency ("Landlord"), and the BATARSE FAMILY TRUST, U.T.A. <br />DATED MAY 7, 1987, ANTHONY A. BATARSE, JR., TRUSTEE ("Tenant"). <br />RECITALS <br />A. On or about May 7, 1997, Landlord and Tenant entered into that certain Ground <br />Lease for the Automall Reader Board Sign ("Lease"). On or about June 4, 1997, Landlord and <br />Tenant entered into a First Amendment to the Ground Lease for the Automall Reader Board Sign <br />("First Amendment").On or about December 15, 1997, Landlord and Tenant entered into a <br />Second Amendment to the Ground Lease for Automall Reader Sign Board ("Second <br />Amendment"). On or about June 10, 2002, Landlord and Tenant entered into a Third <br />endment to the Ground Lease for Automall Reader Sign Board. On or about <br />mom, 2009, Landlord and Tenant entered into a Fourth Amendment to the Ground <br />Lease for Automall Reader Sign Board ("Fourth Amendment"). Pursuant to the Lease and each <br />of the amendments thereto ("Amendments"), Landlord leased to Tenant and Tenant leased from <br />Landlord real property that is more particularly described in the attached Exhibit "A" and <br />incorporated herein by reference ("Premises"). <br />B. Landlord and Tenant desire to execute this Memorandum to provide constructive <br />notice to all third parties of Tenant's rights under the Lease and the Amendments thereto. <br />For good and valuable consideration, the receipt and adequacy of which is hereby <br />acknowledged, Landlord and Tenant agree as follows: <br />1. TERM. Landlord leases the Premises to Tenant for a term of forty (40) <br />years, commencing on June 1, 1997 and ending on June 1, 2037. <br />2. LEASE TERMS.
