BATARSE, JR., TRUSTEE ("Tenant"). <br />RECITALS <br />A. On ox about'May 7,1997, Landlord and Tenant enteredinto -that certain Ground <br />Lease for the Automall Reader Board Sign.("Lease"'). On or about June 4, 1997, Landlord and <br />Tenant entered into :a First Amendment to the Ground Lease for the Automall Reader Board .Sign <br />.("FirstAmendment").On or about.December l~, .199'7, Landlord and Tenant entered into a <br />Second Amendment to the Ground'Lease for Automall Reader Sign Board.("Second <br />Amendment"). On or.about June :10, 2002, Landlord and Tenant entered into a Third. <br />.Amendment to the Cnroundl,ease for Automall Reader SignBoard. On or about July 2, 2009, <br />Landlord. and Tenant :entered into a Fourth Amendment to the .Ground Lease fax .Automall <br />Reader Sign Board ("Fourth .A;mendment"). Pursuant to the Lease and each of the amendments <br />thereto (".:Ammendments"), Landlord leased to Tenant and Tenant leased from Landlord zeal <br />property that is more particularly described in the attached Exhibits "A"' and"B" and <br />lvlemoxandum of Lease Instrument No. 2009324945 of the Alameda County Records and <br />'incorporated herein by reference ("Premisesy'). <br />B. Landlord .and Tenant desire to execute this Memorandum to provide constructive <br />notice to all third parties of Tenant's rights under the Lease and-the .A:mendments thereto. <br />For good .and valuable consideration, the receipt and adequacy of which ishereby <br />acknowledged, Landlord and Tenant agree as follows: <br />1. TERM. Landlord. leases the Premitses to Tenant for a term of forty (40) <br />,years, .commencing on June 1.,1997 .and ending on June 1, 2037. <br />2. T.;EASE TERIvIS.
