Item 5: Oral Communications <br />None. <br />Item 6: Public Hearing -- PLN2008-00030 <br />Site Plan Review Permit and Vesting Tentative Map, PLN2008-00030 is a Single Lot <br />(condominium purposes) Vesting Tentative Map and a Plan Review Permit for a 200 -Unit <br />Market Rate Condominium Housing Project with 290 parking spaces and approximately <br />5,000 square feet of retail. <br />The site is identified as "Cornerstone at San Leandro Crossings" (APN 075-0039-007-05 and <br />zoned DA -4(S)). In addition to the Cornerstone, the hearing shall include the Replacement <br />Parking Garage with 339 parking spaces to be located on lot 3 of Vesting Tentative Map <br />8010. Applicant is Westlake Development Partners, LLC. <br />These are two separate projects, all part of proposed San Leandro Crossings' master plan <br />that also includes the following individual projects: <br />• The Alameda, a 100 -unit affordable community <br />• The San Leandro Boulevard Street and Pedestrian Improvements <br />• The Martinez Street and Pedestrian Improvements <br />• The Downtown Street Pedestrian and Lighting Improvements. <br />This project tiers off an Environmental Impact Report prepared for the Downtown San Leandro <br />Transit -Oriented Development Strategy (TOD) that was certified in September 2007. The City <br />has prepared, noticed and circulated a Mitigated Negative Declaration for this project. Comments <br />on the Mitigated Negative Declaration were required to be submitted to the City by April 21, <br />2009. The final Mitigated Negative Declaration includes the comments received by the City on or <br />before April 21, 2009. The mitigation measures identified in the Mitigated Negative Declaration <br />address all potentially significant project -related impacts resulting in no significant impacts. <br />Therefore, there is no substantial evidence that the project may have a significant effect on the <br />environment. <br />Senior Planner Millenbah gave the staff report. Be indicated that some residents have called to <br />say that use of this site for condominiums is inappropriate, the density too high and the structures <br />too tall, but the project conforms to the underlying zoning code in all respects. He called attention <br />to a number of land transactions necessary to accomplish the project, noting that BART's Board <br />of Directors has not yet approved any of them. In regards to the Conditions of Approval <br />incorporated in the published staff report, be indicated that I.A. has been revised. Rather than the <br />language printed, that condition now says: <br />Construction shall commence following City Council approval. A one-year extension may <br />be granted by the Community Development Director and a subsequent one-year <br />extension may be granted by the Planning Commission. <br />An addition to the language now says: <br />Commencement of construction shall be defined as when the Applicant files a grading <br />permit and begins grading the site. <br />Further, this language applies to both the Cornerstone and the Replacement Parking Garage. <br />
