Hollister <br />City Manager <br />RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A LETTER <br />AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF SAN LEANDRO AND <br />ALAMEDA CO UNTY IND USTRIES, INC. <br />SUMMARY AND RECOMMENDATION <br />Staff recommends authorizing the City Manager to execute a letter amendment to the Franchise <br />Agreement for Solid Waste, Recyclables, and Green Waste Services ("Agreement") between the <br />City of San Leandro and Alameda County Industries, Inc. (ACI). The letter amendment would <br />modify the conditions of the Agreement as it is extended for an additional term. <br />BACKGROUND <br />The City of San Leandro entered into the Agreement with ACI on February 1, 2000 for a period <br />of ten (LO) years with an option to extend the term an additional ten (10) years. As part of the <br />extension process, the City has conducted a performance and financial review of ACI's billing <br />records and payments to the City. In addition, the City Council approved a ten percent (10%) rate <br />increase effective July 1, 2009, with the provision that the City and ACI will negotiate <br />amendments to the Agreement for the purposes of streamlining the rate review process and for <br />providing additional collection services to rate payers. <br />Analysis <br />On October 21, 2008, the City entered into a contract with R3 Consulting Group (R3) to conduct <br />a Review and Assessment of the Contract Services provided by ACI as required under Section <br />3.3 of the Agreement. The results of the review indicate that ACI is in material compliance with <br />the terms of the contract, has corrected areas of non-compliance identified in the 2005 Review <br />and Assessment, and has met all of the financial obligations to the City. In addition, R3 provided <br />the following recommendations to enhance ACI's operational and financial performance: <br />• Use a "true" 20-gallon residential cart to avoid problems of under-billing; <br />• Increase supervisor safety and quality service observations; <br />• Schedule routine painting and refurbishing of bins and debris boxes; <br />• Enhance safety reporting and analysis; <br />
