IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION N0.2009-117 (1078) RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A LETTER AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF SAN LEANDRO AND ALAMEDA COUNTY INDUSTRIES, INC. WHEREAS, the City of San Leandro ("City') and Alameda County Industries, Inc.("ACI"), executed that certain Franchise Agreement for Solid Waste, Recyclables, and Green Waste Services between the City of San Leandro and Alameda County Industries, Inc., dated February 1, 2000 ("Franchise Agreement"); and WHEREAS, the Franchise Agreement was amended by the City and ACI during its term; and WHEREAS, the City and ACI desire to fiarther amend the Franchise Agreement, by letter amendment, to modify the franchise services provided by ACI; and WHEREAS, pursuant to the letter amendment, the City will renew the Franchise Agreement for an additional ten (10) year term with the option to renew the term for up to five (5) additional years contingent upon ACI's vehicle replacement schedule; and WHEREAS, pursuant to the letter amendment, the City and ACI will perform an annual rate adjustment using a Refuse Rate Index (RRI) and will no longer compare rates at five (5), ten (10), and fifteen (15) years; and WHEREAS, pursuant to the letter amendment, ACI agrees to provide garbage, recycling, and green waste collection services to San Leandro Unified School District facilities within the ACI service area at no charge to the District; and WHEREAS, contingent upon certain events contained in the letter amendment, ACI agrees to provide additional services and compensation to the City and ACI customers; and WHEREAS, said letter amendment to the Franchise Agreement, a copy of which is attached hereto, was presented to the City Council. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: That said letter amendment is hereby approved and execution thereof by the City Manager, or his designee, is hereby authorized.
