AGREEMENT BETWEEN CITY OF SAN LEANDRO AND SAN LEANDRO UNIFIED <br />SCHOOL DISTRICT FOR SOLID WASTE, RECYCLABLES AND GREEN WASTE <br />COLLECTION AT SCHOOL FACILITIES WITHIN THE ALAMEDA COUNTY INDUSTRIES <br />SERVICE AREA. <br />THIS AGREEMENT is made and entered into this~~{hday of Jt~, 2009 by and between <br />CITY OF SAN LEANDRO ("City") and the SAN LEANDRO UNIFIED SCHOOL DISTRICT <br />("District," collectively the "Parties"). <br />RECITALS <br />WHEREAS, the City of San Leandro has entered into a Franchise Agreement with Alameda <br />County Industries ("ACP') to provide Solid Waste, Recyclables, and Green Waste collection services <br />("Services"); and <br />WHEREAS, to the extent that the City extends the agreement with ACI for an additional ten <br />(10) year term, commencing on February 1, 2010, ACI agrees to provide certain Services to school <br />facilities within the ACI service area at no cost to the District; and <br />WHEREAS, The City has the legal responsibility for waste reduction and recycling activities <br />in order to comply with the provisions of AB 939 and SB 1016 for reducing the amount of solid <br />waste that is placed in landfills and the City has established a goal of reducing 75% of waste from <br />landfills by 2010; and <br />WHEREAS, the City has authorized ACI to provide Services to the District with the <br />understanding that the District will actively participate in achieving the aforementioned state <br />mandates and local goals for waste diversion at all school facilities; and <br />WHEREAS, the Ciry and the District will work cooperatively and in good faith to carryout <br />and implement the terms of this Agreement to provide quality and comprehensive solid waste, <br />recyclables, and green waste collection to school facilities. <br />THEREFORE, FOR VALUABLE CONSIDERATION, the receipt of which is hereby <br />acknowledged, the Parties agree as follows: <br />AGREEMENT <br />I. Terms of Service <br />a. The City and ACT agree to provide solid waste, recyclables, and green waste <br />collection services to all District facilities that are located within the ACI <br />service area (reference Appendix A of which the exact configuration will <br />change after the initial waste audit(s)).
