PRESENTATIONS <br />None <br />3. PUBLIC HEARINGS <br />A. Matter of Notice of Intent to Adopt Condemnation Resolution for <br />Easements at 2000 Merced Street (McManus, Owner) and 1777 Abrams Court <br />(Hilf, Owner) for the Storm Drain, Merced Street to Williams Street <br />Project (authorizes City to acquire subject property by eminent domain). <br />This being the time and place for the Public Hearing on the above <br />matter, Rob Caughell, Administrative Assistant for the Engineering <br />Department, introduced the matter, which would authorize the City <br />Attorney to proceed with eminent domain proceedings for the acquisition <br />of easements. He described the storm drain project and showed slides of <br />the site. <br />City Attorney Steve Meyers clarified that the issue for the Hearing was <br />the eminent domain procedure, not the value of the property. <br />Tom McManus, Property Owner, 4037 Natasha, Lafayette, and Peter Turner, <br />1033 Hubert Road, Oakland, spoke in objection to the project. They said <br />the placement will limit future development of the site. They showed a <br />diagram with alternative routes; they said it is similar to that which <br />was proposed for Golden Gate Seafood in 1994. They said the City's <br />proposal is not necessary and asked why there was urgency to this <br />matter. <br />Vice Mayor Polvorosa asked if the alternative routes had been presented <br />to staff. <br />Council Member Loeffler asked for clarification on the process to date <br />and noted the drainage issue had been around for a long time. <br />
