Minutes - City of San Leandro City Council Meeting Page - 5 - <br />September 15, 1997 <br />4. PUBLIC CQMMENTS <br />Public Comments are limited to 5 minutes per person. The public is <br />invited to make any comments related to Agenda items, or other items <br />of public interest, at this time. <br />A. Carey Walker, 471 Santa Monica, addressed the Council regarding <br />James Madison School, noting there are no moneys to open the <br />school, even though Heron Bay gave the School District $2 million. <br />He stated somebody is not watching the store. The Mayor responded <br />that the Council has no authority over funding of the School <br />District. Vice Mayor Loeffler informed Mr. Walker that there is <br />a School Board Meeting tomorrow night at Madison School. <br />Mr. Walker continued by commenting on the continuing problem with <br />the deterioration of railroad tracks in San Leandro. He asked who <br />has control of the street for the railroad tracks. The City <br />Attorney responded that the crossings are regulated by the Public <br />Utilities Commission, and his concerns and remarks should be <br />addressed to State Legislators. <br />B. Lou Filipovich, 15376 Laverne Drive, addressed the Council <br />regarding the Minutes of September 2, 1997, and noted that hi s <br />comments under Public Comments were not adequately stated in the <br />Minutes. He noted that he had informed the Council that there was <br />a violation of the Brown Act when the Mayor failed to ask for any <br />other public comments on the item regarding the proposed <br />Resolution offering a reward for the apprehension of a <br />perpetrator, after she allowed that item to become a public <br />hearing and had other speakers come forward and speak on it. <br />The Mayor did not call for further public comment and instantly <br />had the Council vote on the matter. He stated the Council knows <br />and he knows that was a violation of the Brown Act. He further <br />noted that, in his 35 or 40 years of involvement with the Public <br />Utilities Commission, he has been in many proceedings that have <br />involved rail, water, and motor truck transportation, safety <br />crossings, etc. He agrees with the statement from the Council on <br />who is responsible for the railroad crossings, and continued on by <br />speaking to the issue of deregulation of the railroad, water, and <br />steamship industries in California, concluding that it is actually <br />about employer-employee relationships. He concluded by stating <br />the whole thing is in limbo. <br />The Mayor stated, for the record, that there was no violation of <br />the Brown Act at the last meeting, as referred to by Mr. <br />Filipovich. <br />6. Tom Guarino, Chief Executive Officer, San Leandro Chamber of <br />Commerce, addressed the Council and thanked everyone who supported <br />the Chamber Business BBQ last Friday night. He also commented <br />briefly on the survey that is being circulated regarding the <br />format of City Council Meetings and questioned the status of that <br />survey. <br />
