Mayor Corbett: I'd just like to ask a question of Council Member Galvan - as you <br />know and Bob knows, this process on this sale of this excess capacity has been going on <br />10 years, at least. And, whenever you have a negotiation that takes that long, you know <br />there are the ideas that were put forward at that time -things have changed along <br />Lewelling in those 10 years. And, you know we want to react to what's happening now <br />on Lewelling. And, Gordon, you also know that this is a very - as you know -this is <br />a very delicate issue because you have to have five yeses on this. So, is it your opinion - <br />there are two things I want to ask -one is would making changes at this state jeopardize <br />the five votes -getting the five votes to allow this process to go forward; and, I guess <br />the other question is do you believe if we did not interject it as part of the negotiation <br />for the actual agreement as it stands and we interjected our mitigation concerns as part <br />of the EIR process and as part of the encroachment permit -that would not put us at risk <br />to not achieve the mitigation? I know that's not an easy question to answer because <br />we've been going down this road based on negotiations that happened several years ago <br />and tried to respect those negotiations and also understand that Hayward did what it did <br />during its EIR process and we did not because of the time period 10 years ago - it was <br />not felt that it would be the right thing to do. The Council did vote on that. But, we <br />do want to protect the concerns that Councilman Glaze is speaking to. So, how do we - <br />it's very complicated -how do we deal with that? <br />Council Member Galvan: I think, for one, I would love to go back to, I' m not sure <br />who was on the Council then, but I would love to go back to the Council that made the <br />determination.....
