Mayor Corbett: That's right -it's on the agenda for giving direction. And I am just <br />interrupting because Councilman Galvan looks like he has something that he wants to <br />interject. <br />Council Member Galvan: Well, I think it will answer your question Bob. There's <br />three parts to this process. One is adopting the principles of the agreement between <br />EBDA and LAVWMA. And, the agreement establishes capacity rights for LAVWMA <br />and the financial terms of the agreement between the two agencies -the money part of <br />it -what EBDA is going to receive. And, as a reference point, because a lot of <br />commitments have been made over the years, the agreement also includes language about <br />other commitments and other agreements that may be a part of the document, but are not <br />in the document -such as Hayward's $IOM, such as San Leandro's landscaping plans - <br />those are not intended to be spelled out in detail in this agreement. This agreement is, <br />again, for the financial terms and capacity rights between the two agencies. After that <br />you have an EIR process for the new pipeline project that LAVWMA is proposing. <br />There will be a comment period on the EIR which San Leandro can then say "this is <br />what we want specifically. " And then after the EIR process, again we have another <br />opportunity when they have to pull their permit to start construction on the project. <br />Which again, is another opportunity for us to, again, be very specific as to what we <br />want. So, tonight we don't have to establish all the details, as to exactly what we want <br />to see on Lewelling. There will be plenty of time to do that in the future. What we <br />need to do is take a look at the proposed agreement and see if the financial arrangements <br />and capacity rights in this agreement are acceptable to the City of San Leandro. <br />October 20, 1997 -Verbatim Transcript, Item 6.A 11 <br />
