Section 15. Reallocation of Position <br />An employee in a position reallocated to a lower class <br />shall have the right of either; (1) transferring to a <br />vacant position in his/her present classification <br />provided the department head into which the transfer is <br />proposed agrees; or (2) continuing in the same position <br />in the lower classification with their salary Y-rated. <br />Section 16. Injury on Duty <br />When an employee is incapable of performing his work or <br />duties as a result of injuries received or illness <br />arising in the course of his/her employment by the City <br />and receives benefits pursuant to the Workers' <br />Compensation Act, upon the sole discretion of the City <br />Manager, a full-time competitive service employee hired <br />pursuant to the merit personnel program may be granted a <br />leave with an amount of pay equal to the difference <br />between his/her City pay and the Workers' Compensation <br />pay benefit, if any, received by him/her during such <br />incapacity, but not to exceed one (1) year for any one <br />(1) period of such incapacity. <br />Leave granted an employee under the above provisions <br />shall not be considered sick leave or deducted from <br />accumulated sick leave. <br />When an employee has been injured in the line of duty and <br />receives compensation in accordance with the provisions <br />of any Workers' Compensation Act of the State of <br />California, the Human Resources Director shall have <br />submitted to him/her reports on the forms in the manner <br />prescribed. <br />An employee injured in the line of duty who requires <br />medical care and/or physical therapy shall schedule, as <br />far as practicable, such appointments at a time so as to <br />be as least disruptive to the work schedule. <br />Modified Duty - It is the policy of the City to encourage <br />employee's to return to work as soon as possible. Every <br />effort will be made to accommodate to an employee's <br />medical needs to ensure a speedy return to work. An <br />injured employee is required to cooperate and comply with <br />request for information to facilitate the employees' <br />return to work, either on a modified basis or a return to <br />full duties. <br />19 <br />
