IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2005-020 (1009/1099) <br />RESOLUTION ADOPTING THE MITIGATED NEGATIVE DECLARATION FOR <br />THE SAN LEANDRO RECYCLED WATER PROJECT <br />AS COMPLETE AND IN COMPLIANCE WITH THE <br />CALIFORNIA ENVIlZONMENTAL QUALITY ACT REQUIREMENTS (CEQA) <br />WHEREAS, the City Council proposes to build two water recycling, disinfection <br />and filtration facilities, approximately 0.80 mile of transmission pipeline, and irrigation <br />systems to provide recycled water for irrigation only in accordance with State <br />requirements to the Monarch Bay Golf Complex, Marina Park, the Marina <br />Park/Parcourse, road medians near and around the Monarch Bay Golf Complex and <br />Marina Park; and Oyster Bay Regional Park; and <br />WHEREAS, the proposed Recycled Water Project implements the San Leandro <br />General Plan policy for water resource conservation (Action 27.02-B) and has been <br />presented to the City Council of the City of San Leandro ("City Council"); and <br />WHEREAS, the City Council finds that the proposed Recycled Water Project is <br />entirely consistent with the San Leandro General Plan and does not propose any changes <br />to its land use designations, densities, or development policies; and <br />WHEREAS, an environmental consultant under contract to the Public Works <br />Department has prepared and circulated for public review an Initial Study which <br />demonstrates that the proposed Recycled Water Project would have no significant or <br />potentially significant environmental impacts, and a draft Mitigated Negative Declaration <br />(included as Attachment A of the staff report and incorporated herein by reference) was <br />prepared and circulated for public review; and <br />WHEREAS, the potentially significant impacts identified in the Mitigated <br />Negative Declaration are deemed to be mitigated to a level of insignificance with <br />incorporation of recommended mitigation measures; and <br />WHEREAS, comments received during the public review and comment period <br />have been responded to by the City and environmental consultant (included in <br />Attachment A); and <br />WHEREAS, the City Council has conducted a public hearing and reviewed and <br />considered the Mitigated Negative Declaration and Mitigation Monitoring Program, and <br />has determined that it has been completed by the environmental consultant in compliance <br />with the requirements of the California Environmental Quality Act; and <br />WHEREAS, the office of the Department of Public Works of the City of San <br />Leandro is located at 1420Q Chapman Road, San Leandro, California, and said <br />
