financed, describes the estimated cost of these facilities, and describes the reasonable relationship <br />between the use of the fee, the need for the fee and the types of development proj ects on which the <br />fee is imposed and setting forth time for payment; and <br />WHEREAS, staff has prepared a report dated May 24, 2005, which is attached as Exhibit A <br />(hereafter the "Report"); and <br />WHEREAS, the Report demonstrates the appropriateness of revising the Park Impact Fee <br />based on current estimates of the cost of City park facilities needed to accommodate new <br />development, subject in part to the Quimby Act,; and <br />WHEREAS, in accordance with Government Code Section 66016, at least 14 days prior to <br />the public hearing at which this Resolution was adopted, notice of the time and place of the hearing <br />was mailed to eligible interested parties who filed written requests with the City for mailed notice of <br />meetings on new or increased fees or service charges; and <br />WHEREAS, in accordance with Government Code Section 66016, the Report was available <br />for public review and comment for ten days prior to the public hearing at which this Resolution was <br />adopted; and <br />WHEREAS, 10 days advance notice of the public hearing at which this Resolution was <br />adopted was given by publication in accordance with Section 6062a of the Government Code; and <br />FINDINGS <br />WHEREAS, the City Council finds as follows: <br />A. The purpose of the Park Impact Fee set forth in this Resolution is to finance park <br />facilities to reduce the impacts caused by future development in the City. <br />B. The Park Impact Fee collected pursuant to this Resolution shall be used to finance <br />park facilities to assure that future development does not result in a reduction in current levels of <br />park facilities service. <br />C. After considering the Report, the testimony received at this noticed public hearing, the <br />agenda statements, the General Plan, and all correspondence received (together, "Record"), the City <br />Council approves and adopts the Report and incorporates such report herein and further finds that <br />further development in the City will generate the need for park facilities and that such park facilities <br />are consistent with the General Plan. <br />D. Revision of the Park Impact Fee set forth in this Resolution as it relates to <br />development within the City is intended to obtain funds for capital projects necessary to maintain <br />service within existing City service areas. The City currently provides neighborhood and community <br />park facilities, and the Park Impact Fee revised in this Resolution will be used to maintain current <br />service levels as reflected in the Report.
