CITY OF SAN LEANDRO <br />STANDARD PUBLIC IMPROVEMENT AGREEMENT <br />THIS AGREEMENT, entered into on ll-7-OS by and between the CITY OF SAN <br />LEANDRO, a municipal corporation of the State of California, hereinafter referred to as "City," and <br />IIUDSON ICS, hereinafter referred to as "Owner." <br />In consideration of the granting of certain entitlement of use described as follows: issuance of <br />encroachment permits, for the construction of IIiJDSON LANE, San Leandro, California, Assessor's <br />Parcel No. 075-0087-008 and 075-0087-001 hereinafter referred to as "Project." <br />This agreement is entered into with regard to the following facts and circumstances: <br />A; Owner is the owner of an approximately 15.3 acre parcel located in the City of San <br />Leandro, California (APN 075-0087-008 and 075-0087-001) (the Property) which is currently served by <br />a private roadway, Hudson Lane, that crosses the tracks of the Union Pacific Railroad Company ("Union <br />Pacific"); and <br />B. In order to provide improved public access to the Property, Owner requested that City <br />obtain authority fi-om the California Public Utilities Commission ("PUC") to convert Hudson Lane from <br />a private 40-foot crossing of the Union Pacific tracks into a public crossing; and <br />C. On April 23, 2004, the PUC issued Decision 04-04-045 (the "PUC Decision"), <br />permitting conversion of the crossing upon the performance of certain conditions, including certain <br />modifications to the crossing warning signals; and <br />D. City and Union Pacific have negotiated the terms of a "Railroad Crossing Agreement" <br />pursuant to which Union Pacific will provide City with the necessary property rights for the approved <br />public crossing and perform necessary modifications to the warning signal system; and <br />E. City and Owner desire to enter into this agreement to establish the conditions for City to <br />accept the new crossing as a public street, which include having Owner.
