modifications and (3) undertake certain improvements necessary to bring the private roadway into <br />conformance with City's standards; and <br />F. Owner is entering into this agreement, in part, in consideration for the City entering into <br />a "Railroad Crossing Agreement" with Union Pacific with respect to Hudson Lane and City's acceptance <br />of a portion of Hudson Lane into City's system of streets; and <br />G. City has recently determined that, in order for the existing private roadway to meet its <br />standards, the Crossing should be reconstructed in a 60-foot wide configuration, which will require the <br />acquisition of additional rights from Union Pacific beyond those provided for in the Railroad Crossing <br />Agreement and a filing with the PUC; and <br />H. In light of Union Pacific's desire first to complete the execution of the Railroad Crossing <br />Agreement, the City and Owner are agreeing to have the City enter into that agreement and then to <br />cooperate in taking the steps needed to acquire the additional rights from Union Pacific and obtaining <br />any required PUC approvals; and <br />L The conversion of Hudson Lane to a public railroad crossing, its acceptance by City into <br />its system of public streets and Owner's construction of related street improvements are collectively <br />referred to as "Project." <br />AGREEMENTS <br />1. Performance of Work. Owner agrees to furnish, construct, and install at his own expense <br />all required public improvements as shown on the plans prepared by dk Associates, and identified as Public <br />Improvement Plans for Hudson Lane, San Leandro, Alameda County, a copy of which is on file in the <br />Office of the City Engineer and is incorporated herein by reference and all other improvements required by <br />the City Engineer based upon the standards imposed by Title VII, Chapter 8 of the San Leandro Municipal <br />Code of 1985 and the Standard Specifications adopted by the City of San Leandro for public works. <br />Owner's costs shall include all necessary relocation of existing utilities. <br />STANDARD PUBLIC IMPROVEM&NT AGREEMENT <br />G:A_LD\ Address\400 Hudson Ln -Hudson Property\1155057_3.DOC <br />Page 2 of ] 6 <br />1155057.3 <br />
