SECTION 5 - GINERAL PROVISIONS <br />(a) The GFA <br />This GFA, the application for such GFA, any Administrative Notices and any <br />endorsements or riders thereto, when issued to the GFA Owner constitute the e~ire GFA. <br />All statements in the application shall, in the absence of fraud, be deemed representations <br />and not warranties. No statement shall void this GFA or be used in defense of a claim <br />under it unless captained in the written application for this GFA C~'A Years, months and <br />anniversaries shall be computed from the Effective Date of this GFA <br />(b) Modification of the GFA <br />This GFA may be modified at a~ time by written agreement between, the GFA Owner and <br />the Company. In addition, this GFA may be.modified at any time by the Company to <br />comply with applicable law. No modification may operate in a manner inconsistent with <br />the GFA Control Provisions of this GFA <br />On and after the fifth GFA Year, the Company may modify any or all the terms of this <br />GFA upon 90 days' advance written notice of such change to the GFA Notwithstanding <br />a~ such changes, the guaranteed interest rates which apply on the effective date.of the <br />-GFA continue to apply to all contributions, and earrings, if aay thereon, in effect at the <br />time the contribution was credited to the GFA Owner. <br />Any modification of iris GF'A requires the signature of the President, a Vice President, an <br />Assistant Vice Presidenf.or Secretary of the Company. <br />(c) Suspension of the GFA <br />The GFA Owner may suspend this GFA upon ninety (90) days advance written notice to <br />the Compaq at its Office in Hartford, Connecticut (or at any other address fne Compaq <br />map specify). On suspension, Contributions will not be accepted by the Company. <br />(d) Non-Participating <br />This GFA does not share in the surplus earnings of the Company. <br />(e) Overoayments/Underpayments <br />Any underpayments by the Company shall be made up immediately and any overpaymeirts <br />shall first be charged. against future amour becoming payable. <br />HL-1653 14 <br />
