8.4 Hartford Life representatives shall provide, in a manner <br />corsstent with insurance and securities law, information to help <br />each employee understand the various Investinent Options <br />approved by the Plan Sponsor. <br />8.5 Forms and materials required to maintain Padicipant and <br />Plan level records for the Ptah shag be provided at no adc4tarral <br />twat to the Plan Sponsor. <br />8.6 M parsons and companies eutxarized to offer irrvestmerrrs <br />under the Pinn must be duly licensed by the applitxble state and <br />federal regulatory agencies. All Hertford Life personnel that have <br />contact with employees, ether than of a routine admir>istiative <br />nature, wtil have any n~essary state ir~urar~e Lenses and wtil <br />be registered with the NASD, to the extent required try inw, and <br />wid be trained, linevsed, and supervised with respect to the <br />conducting df their business activities hereunder. <br />8.7 Hartford Life shag ass'st each Padicipant in calculating h's or <br />her deferral linritafion under apptic~lrle law, help to recorx~e arty <br />account discxeparx;ies, and provide infomrafian to expl~n the <br />pmc~lures of the Plan. <br />B.@ Upon request by any Parf~pant in the Plan, a representative <br />shall provide information about the. various payout options <br />available under the Plan, sh~l preside an annuity or installmerrt <br />Payment tilustration and shell help the Participant complete the <br />necessary eppication and other .forms in order to n3ceive <br />payment. <br />8.@ Unless the Ptah Sponsor elects otherwise below or until <br />notified in writing by the Plan Sponsor otherwise, Hartford Life <br />wrl arrange to make avaieble the services identified below. <br />Hartfprd Lice has made arrangements far Morningstar <br />A~oaates, LLC to provide Mamingstar ClearFuhxe online <br />ihvestmerd guidance, research and educationail serves to Plan <br />Participards. The Mamingster ClaarFuture service ~ acrx;;sed <br />through a seaxe tirdc on the HartfordOnfine group retirement plan <br />wetx;tte. Ths online service provides the Plan and its <br />Parfic with access to res~rch, education and asset <br />allocetion recortrmetula6ors only, it does not provide <br />recommendations of speafic irwestrneM choices. Through this <br />service, the Plan Sponsor will hate aa~s to participant usage <br />statistics through the Morningstar ClearFutirre • Sponsor <br />Measunerrrenf Module. Morningstar Associates LLC ~ not <br />aflii~ed with Hartford Life. To maJce this service avaihable, <br />Hartford Ufa ~I share with Morningstar Assoaates, LLC all <br />necessary Plan and Plan Particrpant information on record at <br />Hertford Life. ff you do not want us to share information with <br />Morningstar, you must elect below not to have the Morningstar <br />CtearFuture services made avatiable to the Phan and its <br />Participants. There is no fee for this service. Hartford Life may <br />discontinue making this service av~il~rle at any time. Hertford <br />L"rte Moll make good-faith efforts to provide a similar service <br />should Hartford Life elect to dscontinue the Morningstar <br />ClearFuture service. The Plan Sponsor may discontinue access <br />to this service at arty time by written notice to Hartford Life. <br />^ Do not make the Morningstar ClearFuture services available <br />to the Plan and its Particaparrts. <br />10.0 Records Management <br />10.1 Except ~ ottrenrrise provided herein, Hartford Life shall <br />retain all financial records and supporting documents, <br />correspondence and other written matelots pertaining to the <br />Investment Options, the Plan and all federal and state incorrre <br />taxes withheld for three years followQrg the date of termination of <br />this Agreertrertt, or, ff laden, the time presarbed by federal taw, but <br />only with respect to those items to which the taw applies. <br />Hartford Life may retain salt records and doarmeMs on <br />m~roftim, miaofiche, optical storage, or arty other process that <br />accuratey reproduces or fomrs a curable mecum for <br />reprodudng the original. The Pinn Sponsor has the right to make <br />duplicate cxrpies at Plan Sponsor's expense. <br />10.2 ff an audit of the Ptan has begun, cwt has not been <br />completed at the end of the thna3-yam period, or'rf outfit fincings <br />Crave not been resoHed at the end of the thn:e-year period, <br />Hartford Cafe shop retain the records described in Section 1D.1 <br />until the audit fincinc,~ are resdved <br />10.3 If, for any reason, Hartford Lie yes aperatians prior to <br />the expiration of the records retention period required by th's <br />section, all records descxined in Section 1D.1 shat, upon request <br />of the Plan Sponsor, be made available to the Plan Sponsor. <br />10.4 Upon reasonable written request and durQrg normal <br />business hens, Hartford Life shall allow the Plan Sponsor firti <br />and carnplete access to all records required io be rateirred by <br />Hartford Life. <br />10.5 The Plan Sponsor shall have the right upon reasonable <br />wdtten nofa:e, exercised directly or through its independent <br />auditors, to examine and audit Hartford Lifer records to <br />determine Harffoni Life`a camptiance with the temrs and <br />corxiiions herein. <br />10.8 The Plan Sponsor acknowledges that Hartford Life ~ not <br />responsinle far auditing Plan Sponsor records or data for the <br />Ptah. <br />11.1 The Agreement may be amended by Hartford life upon <br />written consent of itre Em~vyer, which consent shall not be <br />unn3asorrabty withheld, by providir>A W days written rwtice of the <br />amencknent to fhe Employer. ff the Plan Sponsor does not <br />provide Hartford L'rfe with a written objection to such proposed <br />amendment wjthin 9D days of recapt, the amendment shall be <br />457 Aft -01-03 <br />
