IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2004-105 (1055/3006) <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LEANDRO CALLING A <br />SPECIAL MUNICIPAL ELECTION FOR SUBMISSION OF A QUESTION TO THE <br />QUALIFIED VOTERS RELATING TO THE IMPLEMENTATION OF A PUBLIC SAFETY <br />PARCEL TAX; CONSOLIDATING THE SPECIAL MUNICIPAL ELECTION WITH THE <br />GENERAL MUNICIPAL ELECTION TO BE HELD TUESDAY, NOVEMBER 2, 2004; <br />APPROVING THE FORM OF THE BALLOT QUESTION; SETTING FORTH <br />PROCEDURES FOR BALLOT ARGUMENTS AND DIRECTING THE CITY CLERK TO <br />SUBMIT THE MEASURE TO THE CITY ATTORNEY FOR IMPARTIAL ANALYSIS <br />WHEREAS, at its regular meeting of June 21, 2004, the City Council of the City of San <br />Leandro considered placement of a measure on the November 2, 2004 ballot to request voter <br />approval of a tax; and <br />WHEREAS, in adopting the fiscal year 2004-OS budget, the Council concluded that <br />additional filnding is necessary for public safety services; and <br />WHEREAS, under the provisions of the Charter, a General Municipal Election shall be <br />held on November 2, 2004, for the election of Municipal Officers; and <br />WHEREAS, the City Council also desires to call a Special Election to submit to the <br />voters at the election a question relating to the implementation of a Public Safety Parcel Tax; and <br />WHEREAS, Article XIIIC, section 2(c) of the California Constitution requires that any <br />special tax must be approved by atwo-thirds vote of the voters voting on the issue of the <br />imposition of the tax; and <br />WHEREAS, the City Council finds that under CEQA Guidelines 15060(c)(2) and 15378, <br />subdivisions (2) and (4) of subdivision (b), this tax does not constitute a project under CEQA and <br />therefore review under CEQA is not required. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN LEANDRO, <br />CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: <br />SECTION 1. The City Council hereby calls a Special Municipal Election of the <br />qualified voters of the City of San Leandro, to beheld on November 2, 2004 to submit to the <br />voters a ballot measure regarding whether or not an excise tax should be imposed on real <br />property to pay for public safety services. <br />
