SECTION 2. The ballot measure shall appear and be printed upon the ballots to be used <br />at the Election as follows: <br />Shall the current level of police and fire protection services be maintained at a minimum <br />of 94 sworn police officers and a minimum of 7 fire companies by adoption of an YES <br />ordinance imposing a parcel tax in an annual amount of $78 for single-family residences, <br />$46.80 per multi-family unit and $16 per thousand square feet for industrial and <br />commercial properties, such parcel tax to end after five and one-half years? NO <br />SECTION 3. The tax to be enacted by the voters pursuant to Section 2 shall be in the <br />form set forth in the Ordinance (Attachment 1), attached hereto, and incorporated by reference <br />herein. <br />SECTION 4. Pursuant to the provisions of the Elections Code of the State of California, <br />the City Council of the City of San Leandro hereby requests that the Special Municipal Election <br />of the City of San Leandro to consider this measure be held November 2, 2004, in conjunction <br />with and to be consolidated with the General Municipal Election for the City of San Leandro and <br />the statewide election to be held in the City of San Leandro on said date, and further requests the <br />Board of Supervisors of the County of Alameda to make its order of consolidation and thereafter <br />call said consolidated election, and to direct the Alameda County Registrar to conduct all <br />necessary services related to said election and to bill the City for the cost of conducting said <br />election. <br />SECTION 5. That notice of the time and place of holding the election is given and the <br />City Clerk is authorized, instructed and directed to give further or additional notice of the <br />election, in time, form and manner as required bylaw. <br />FURTHER, the City Council of the City of San Leandro does hereby RESOLVE as <br />follows: <br />1. That written arguments for and against the ballot measure submitted to the voters of <br />the City of San Leandro to be considered at the November 2, 2004 General Municipal <br />Election will be permitted, not to exceed 300 words. <br />2. That the authors may prepare and submit rebuttal arguments not exceeding 250 words. <br />The rebuttal arguments shall be filed with the City Clerk not more than ten (10) days <br />after the fmal date for filing direct arguments. <br />3. That pursuant to Section 9280 of the California Elections Code this Council hereby <br />directs that the City Attorney prepare an impartial analysis of the measure to be placed <br />before the electorate. <br />4. That the City Clerk shall set the dates for filing of the arguments for and against the <br />ballot measure. <br />5. That no additional materials shall be authorized for submission to the City Clerk or <br />shall be submitted by proponents or opponents of this measure to be mailed in addition <br />to the Sample Ballot and Voters' Pamphlet. <br />6. That in all other respects the provisions of Section 9280 through 9287 of the California <br />Elections Code and other provisions of law pertaining thereto shall govern. <br />RESOLUTION NO. 2004-1OS 2 <br />
