IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO
~G'¢7
RESOLUTION N0.2004-129 (3~O~Fr~
RESOLUTION APPROVING FINDINGS FOR VESTING TENTATIVE MAP
(Vesting Tentative Map, Tract 7497; 915 Lewelling Boulevard;
Assessor's Parcel Number 80G-1290-13)
Findings
The City Council of the City of San Leandro finds that the proposed map, together with the
provisions for its design and improvements, are as follows:
A. The proposed map will be consistent with the General Plan in that it provides for
medium-density residential as a conditionally permitted use in an area designated for
high-density residential development. The proposed medium-density would be
compatible with the existing high-density residential development adjacent to the west of
the site and the low-, medium-density residential development, and a school campus in
the immediate adjacent area.
B. The design and improvements of the proposed subdivision is consistent with the General
Plan in that it includes an orderly division of parcels which are adequately served by
streets and with drainage for residential row-home development. In addition the project
fulfills a mix of residential development types in the City, including single-family homes
on a variety of lot sizes, as well as townhomes, row houses, live-work units, planned unit
developments and multi-family housing.
C. The site is physically suitable for residential development in that it is relatively flat, and
there are no known problems regarding cultural, historical or scenic aspects. Soil stability
will be reviewed thoroughly prior to issuance of building permits. Some of the new plant
material proposed will be native variety or drought tolerant type plants.
D. The proposed density of development of one dwelling unit per 2,445 square feet (18
unitslacre) will be conditionally compatible with high density designation and nearby
existing low- density single-family development.
E. The design of the subdivision or proposed improvements are not likely to cause
substantial environmental damage or substantially and avoidably injure fish or wildlife or
their habitat. This project to construct six residential units is categorically exempt from the
California Environmental Quality Act (CEQA) per CEQA Guideline Article 19,
Categorical Exemption, Sections 15303 (b) and 15332. Furthermore, the rezoning is
exempt from CEQA, per CEQA Guideline, Section 15061 (b) (3), where it can be seen
with certainty that there is no possibility that the rezoning in question may have a
significant effect on the environment.
