IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />~G'¢7 <br />RESOLUTION N0.2004-129 (3~O~Fr~ <br />RESOLUTION APPROVING FINDINGS FOR VESTING TENTATIVE MAP <br />(Vesting Tentative Map, Tract 7497; 915 Lewelling Boulevard; <br />Assessor's Parcel Number 80G-1290-13) <br />Findings <br />The City Council of the City of San Leandro finds that the proposed map, together with the <br />provisions for its design and improvements, are as follows: <br />A. The proposed map will be consistent with the General Plan in that it provides for <br />medium-density residential as a conditionally permitted use in an area designated for <br />high-density residential development. The proposed medium-density would be <br />compatible with the existing high-density residential development adjacent to the west of <br />the site and the low-, medium-density residential development, and a school campus in <br />the immediate adjacent area. <br />B. The design and improvements of the proposed subdivision is consistent with the General <br />Plan in that it includes an orderly division of parcels which are adequately served by <br />streets and with drainage for residential row-home development. In addition the project <br />fulfills a mix of residential development types in the City, including single-family homes <br />on a variety of lot sizes, as well as townhomes, row houses, live-work units, planned unit <br />developments and multi-family housing. <br />C. The site is physically suitable for residential development in that it is relatively flat, and <br />there are no known problems regarding cultural, historical or scenic aspects. Soil stability <br />will be reviewed thoroughly prior to issuance of building permits. Some of the new plant <br />material proposed will be native variety or drought tolerant type plants. <br />D. The proposed density of development of one dwelling unit per 2,445 square feet (18 <br />unitslacre) will be conditionally compatible with high density designation and nearby <br />existing low- density single-family development. <br />E. The design of the subdivision or proposed improvements are not likely to cause <br />substantial environmental damage or substantially and avoidably injure fish or wildlife or <br />their habitat. This project to construct six residential units is categorically exempt from the <br />California Environmental Quality Act (CEQA) per CEQA Guideline Article 19, <br />Categorical Exemption, Sections 15303 (b) and 15332. Furthermore, the rezoning is <br />exempt from CEQA, per CEQA Guideline, Section 15061 (b) (3), where it can be seen <br />with certainty that there is no possibility that the rezoning in question may have a <br />significant effect on the environment. <br />
