IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION N0.2004-156 (3035) <br />RESOLUTION APPROVING FINDINGS FOR <br />VESTING TENTATIVE MAP, TRACT 7560; 82 CHUMALIA STREET <br />RESIDENTIAL CONDOMINIUM SUBDIVISION AT THE NORTHWEST CORNER OF <br />CHUMALIA STREET AND HYDE STREET <br />ASSESSOR'S PARCEL NUMBERS 77-446-1-2 AND 77-446-2 <br />Findings <br />The City Council of the City of San Leandro finds that the proposed map, together with the <br />provisions for its design and improvements, are as follows: <br />A. The proposed map will be consistent with the General Plan in that it provides for ahigh- <br />density residential development in what has been designated in the General Plan as a <br />"High Density" land use area. The high-density residential use would be compatible with <br />the commercial and residential zoning in the downtown area, which allows for increased <br />density in this core area. The proposed plan carries out General Plan Policies 3.01 and <br />3.04 which is to encourage a mix of residential development types in the City, including <br />single-family homes on a variety of lot sizes, as well as townhomes, row houses, live- <br />work units, planned unit developments and multi-family housing and to encourage infill <br />development on vacant or underused sites within residential areas, respectively. The City <br />Engineer has also determined that Tentative Map 7560 is also consistent with the City's <br />Subdivision Ordinance. <br />B. The design and improvements of the proposed subdivision are consistent with the General <br />Plan in that it includes an orderly division of a parcel which is adequately served by <br />streets and with drainage for the mixed-use development. <br />C. The site is physically suitable for residential condominium development in that a fair <br />amount of the site is relatively flat. This site area would accommodate the proposed <br />condominium development. Moreover, the development would comply with the City's <br />Watercourse Protection Ordinance and maintain the minimum setback of 20 feet from the <br />delineated top of the creek bank. In addition, there are no known problems regarding <br />cultural, historical or scenic aspects. <br />D. The proposed density of development of approximately one dwelling unit per 1,800 <br />square feet (13.5 units/acre) will be compatible with the adjacent medium-density multi- <br />family development to the west and the east. The high-density residential use would be <br />compatible with the commercial and residential zoning in the downtown area. <br />E. The design of the subdivision or proposed improvements is not likely to cause substantial <br />environmental damage or substantially and avoidably injure fish or wildlife or their <br />habitat.
