IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2004-176 (1055/3043) <br />RESOLUTION CALLING AN ALL-MAIL BALLOT SPECIAL MUNICIPAL RUN-OFF <br />ELECTION FOR THE ELECTION OF CITY COUNCILMEMBER, DISTRICT 4; <br />PROVIDING NOTICE OF ELECTION ON THE 8TH DAY OF FEBRUARY, 2005 AND <br />DIRECTING THAT SAID NOTICE BE GIVEN; AND REQUESTING THAT THE <br />ALAMEDA COUNTY BOARD OF SUPERVISORS DIRECT THE ALAMEDA COUNTY <br />REGISTRAR OF VOTERS TO PROVIDE ALL NECESSARY SERVICES RELATED TO <br />SAID ELECTION <br />WHEREAS, a General Municipal Election was held on Tuesday, November 2, 2004, for <br />the purpose of electing City Councilmembers for Districts 2, 4 and 6 for a full term of four years; <br />and <br />WHEREAS, no candidate for the office of City Councilmember, District 4 received at <br />least 50% plus one of the votes cast for that office; and <br />WHEREAS, Section 225(b) of the Charter of the City of San Leandro requires a <br />successful candidate for elective office to receive at least 50% plus one of the votes cast for that <br />office, and in the event that no candidate for such elective office receives 50% plus one of the <br />votes cast for that office, the City Council shall provide for arun-off vote to determine the person <br />elected. <br />WHEREAS, Ordinance No. 2004-012 of the City Council of the City of San Leandro sets <br />forth the procedure for the conduct of run-off elections among the two persons having the highest <br />number of votes for an office by all-mail ballot 90 to 130 days after the General Election. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />DOES RESOLVE AS FOLLOWS: <br />SECTION 1. Pursuant to the provisions of Sections 225(b) and 605 of the Charter of the <br />City of San Leandro, the City Council hereby calls a Special Municipal Run-Off Election, to be <br />held on February 8, 2005, and conducted by all-mail ballot, among the two persons having the <br />highest number of votes for the office for the office of Councilmember, District 4, in the <br />November 2, 2004 General Municipal Election. <br />SECTION 2. The City Council of the City of San Leandro hereby requests that the Board <br />of Supervisors of the County of Alameda direct the Alameda County Registrar of Voters to <br />provide all necessary services related to said election and to bill the City for the cost of <br />conducting said election. The City Manager is hereby authorized to execute an agreement for <br />such services if an agreement is required by the County. <br />
