IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2004-176 (1055/3043) RESOLUTION CALLING AN ALL-MAIL BALLOT SPECIAL MUNICIPAL RUN-OFF ELECTION FOR THE ELECTION OF CITY COUNCILMEMBER, DISTRICT 4; PROVIDING NOTICE OF ELECTION ON THE 8TH DAY OF FEBRUARY, 2005 AND DIRECTING THAT SAID NOTICE BE GIVEN; AND REQUESTING THAT THE ALAMEDA COUNTY BOARD OF SUPERVISORS DIRECT THE ALAMEDA COUNTY REGISTRAR OF VOTERS TO PROVIDE ALL NECESSARY SERVICES RELATED TO SAID ELECTION WHEREAS, a General Municipal Election was held on Tuesday, November 2, 2004, for the purpose of electing City Councilmembers for Districts 2, 4 and 6 for a full term of four years; and WHEREAS, no candidate for the office of City Councilmember, District 4 received at least 50% plus one of the votes cast for that office; and WHEREAS, Section 225(b) of the Charter of the City of San Leandro requires a successful candidate for elective office to receive at least 50% plus one of the votes cast for that office, and in the event that no candidate for such elective office receives 50% plus one of the votes cast for that office, the City Council shall provide for arun-off vote to determine the person elected. WHEREAS, Ordinance No. 2004-012 of the City Council of the City of San Leandro sets forth the procedure for the conduct of run-off elections among the two persons having the highest number of votes for an office by all-mail ballot 90 to 130 days after the General Election. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN LEANDRO DOES RESOLVE AS FOLLOWS: SECTION 1. Pursuant to the provisions of Sections 225(b) and 605 of the Charter of the City of San Leandro, the City Council hereby calls a Special Municipal Run-Off Election, to be held on February 8, 2005, and conducted by all-mail ballot, among the two persons having the highest number of votes for the office for the office of Councilmember, District 4, in the November 2, 2004 General Municipal Election. SECTION 2. The City Council of the City of San Leandro hereby requests that the Board of Supervisors of the County of Alameda direct the Alameda County Registrar of Voters to provide all necessary services related to said election and to bill the City for the cost of conducting said election. The City Manager is hereby authorized to execute an agreement for such services if an agreement is required by the County.
