Cultural Resources, continued <br />c) Directly or indirectly destroy a unique ~ ~ ~ ~ ® 11 12, <br />paleontological resource or site or unique 26 <br />geologic feature? <br />d) Disturb any human remains, including ~ ~ ~ ~ ® 11,12, <br />those interred outside of formal 26 <br />cemeteries? <br />Discussion: <br />V(a): The updated Housing Element advocates the replacement of marginal commercial and industrial uses with residential <br />uses. This is consistent with the adopted Midtown Specific Plan and the current General Plan. <br />A number of the City's older commercial and industrial sites contain potentially historic buildings. Increased pressure to use <br />these sites for housing, as advocated in the Housing Element, could result in a loss of historic resources. The City currently <br />requires that developers implement provisions to protect unique historic and archaeological resources discovered on <br />construction sites. It also requires that historic buildings be safeguarded from demolition or inappropriate alterations. These <br />requirements would continue to apply after the Housing Element is adopted. <br />The Midtown Specific Plan EIR enumerated several mitigation measures to further protect historic resources, including <br />resources which might be threatened by future housing development. These include compliance with Secretary of the Interior <br />Standards for the treatment of historic properties, ongoing review of development along Penitencia Creek for potential impacts <br />to archaeological resources, and requirements to protect unique resources (including human remains) that maybe accidentally <br />uncovered during construction. All of these impacts were deemed mitigatable to a less than significant le gel by the Midtown <br />Plan EIR. <br />VI.
