RECORDING REQUESTED BY: <br />Engineering & Transportation Dept. <br />City of San Leandro <br />835 E. 14th Street <br />San Leandro, CA 94577 <br />WHEN RECORDED MAIL TO: <br />City Clerk <br />City of San Leandro <br />835 E. 14th Street <br />San Leandro, CA 94577 <br />IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2003- 022 (1278) <br />RESOLUTION SUMMARILY VACATING A PORTION OF PUBLIC RIGHT-OF-WAY <br />ON NEPTUNE DRNE; AN APPROXIMATELY 409 FEET LONG SEGMENT <br />ADJACENT TO WASTE MANAGEMENT CORPORATION AT APN 79A-475-7-16 <br />Recitals <br />WHEREAS, a 409 feet long, 80 feet wide segment of Neptune Drive public right-of--way <br />south of Davis Street, adjacent to Waste Management Corporation at APN 79A-475-7-16 to be <br />summarily vacated by this resolution and is more precisely described in Exhibit A and B, <br />attached hereto, and made a part hereof; and <br />WHEREAS, the 409 feet long segment of Neptune Drive is not required for street <br />purposes <br />WHEREAS, the proposed vacation has been found to be categorically exempt from the <br />California Environmental Quality Act; and <br />WHEREAS, there are public utilities located in this proposed area of abandonment, <br />therefore, an existing sanitary sewer easement 40 feet wide strip of Neptune Drive for East Bay <br />Dischargers Authority (EBDA) will be reserved and will remain in effect. <br />
