<br />WHEREAS, said summary vacation is made under Chapter 4 (Summary Vacation) Part 3 <br />Division 9, Section 8330 of the California Streets and Highways Code; <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />1. The City Council hereby orders the summary vacation of the herein above <br />described 409 feet long strip of Neptune Drive public right-of--way. <br />2. The existing sanitary sewer easement 40 feet wide for East Bay Dischargers <br />Authority (EBDA) is reserved and remains in effect. <br />3. The subject vacation shall become operative concurrently with City Council <br />approval of the Final Map for Tract 7382 and the completion of the property transfer between <br />Waste Management Corporation, the City of San Leandro and McMahon Development Group <br />for the Final Map for Tract 7382. <br />4. The City Clerk shall cause a certified copy of this resolution to be recorded in the <br />Office of the Recorder of Alameda County, California immediately upon its adoption. <br />5.
