5. FUNDING <br />Funding for the Mulford-Marina Branch Library and the San Leandro Bayside Education <br />Center, the initial furniture and equipment, and areas for the activities described in this <br />agreement may be offset by revenues from the California Reading and Literacy <br />Improvement and Public Library Construction and Renovation Bond Act of 2000. <br />Ongoing operations, programs, and activities of the Library will be funded by the City of <br />San Leandro General Fund. San Leandro Unified School District will fund sanctioned <br />District activities and programs. <br />6. REVIEW AND MODIFICATION PROCESS <br />During the first three years of this agreement, an equal number of representatives from <br />the Library and the District will meet quarterly to review, evaluate and modify the <br />conditions of this agreement. Beyond year 3, representatives will meet semi-annually to <br />review and modify this agreement. Review and modification meetings may be called as <br />needed by either agency with a 30-day notice. <br />7. THE FIELD ACT <br />The Mulford-Marina Branch Library project is subject to the Field Act requirements for <br />review of plans and specifications by the Division of the State Architect for structural <br />safety, disabled access and fire/life safety. The rationale for this qualification is that the <br />Library Bayside Education Center will be constructed to accommodate more than 24 <br />students in grades K-5 at any one time. <br />S. TERM OF THIS AGREEMENT <br />The City of San Leandro and the San Leandro Unified School District enter into this <br />cooperative agreement for joint use library services for a period of 20 years following <br />completion of the project. <br />The facility itself shall be dedicated ro public library direct service use for a period of 40 <br />years following completion of the project, regardless of any operating agreements the <br />City of San Leandro may have with other jurisdictions or parties. Either party may <br />terminate this agreement with 180 days notice if state funding for the agreement is <br />terminated. <br />9. DISPUTE RESOLUTION <br />If either party defaults in its performance, the aggrieved party shall promptly notify the <br />defaulting party in writing within thirty (30) days. Any dispute shall be first addressed at <br />an administrative level between the parties. If a successful resolution cannot be obtained <br />7 <br />
