Attachment 4 <br />STATEMENT OF OVERRIDING CONSIDERATIONS <br />General. <br />Pursuant to CEQA Guidelines section 15093, the City Council of the City of San Leandro makes <br />the following Statement of Overriding Considerations for those significant unavoidable impacts <br />identified in the General Plan EIR. <br />The City Council has carefully considered each impact in reaching its decision to adopt the <br />Project. Although the City Council believes that the unavoidable environmental effects <br />identified in the EIR will be substantially lessened by mitigation measures incorporated into the <br />Project, and future development plans as well as future mitigation measures implemented with <br />future approvals, it recognizes that the implementation of the Project carries with it unavoidable <br />adverse environmental effects. <br />The City Council specifically finds that to the extent that the identified adverse or potentially <br />adverse impacts have not been mitigated to acceptable levels, there are specific economic, social, <br />environmental, land use, and other considerations that support approval of the Project. <br />Unavoidable Significant Adverse Impacts. <br />The following unavoidable significant environmental impacts are associated with the proposed <br />Project as identified in the EIR. The impacts cannot be fully mitigated by changes or alterations <br />to the Project. <br />Impact C1: Increased Traffic Congestion. Development consistent with the General Plan <br />could generate as many as 93,000 additional daily auto trips by the horizon year of 2015. These <br />trips would contribute to congestion on Interstates 880 and 580, both of which are projected to <br />experience peak hour LOS F by the horizon year of 2015. In addition, traffic conditions on local <br />roadways in San Leandro would deteriorate, with at least one intersection (Davis at San Leandro <br />Boulevard} operating at LOS E. At least 12 other intersections would deteriorate from LOS B or <br />C to LOS D. Although LOS D is deemed acceptable by the General Plan, the added congestion <br />would result in travel delays substantially greater that than experienced today. Thus, <br />transportation impacts are considered significant and unavoidable (see Attachment 2). <br />Impact K2: Increased Air Emissions. Development consistent with the General Plan could <br />result in employment that exceeds the projections used in the Clean Air Plan. The addition of <br />9,275 jobs in the City (over a 15-year period) would lead to additional commuting into San <br />Leandro from other cities in the region, with accompanying air emissions. This could contribute <br />to delays in the attainment of state and federal air quality standards in the San Francisco Bay <br />Area Air Basin.
