Hollister <br />City Manager <br />RESOLUTION IN SUPPORT OF CALIFORNIA STATE ASSEMBLY BILL 962. <br />SUMMARY AND RECOMMENDATION <br />Assembly Bill 962 regulates the sale of handgun ammunition in an attempt to keep ammunition <br />out of the hands of prohibited persons. It also assists law enforcement in keeping records of sale <br />and thumbprints from buyers of handgun ammunition. A violation of this new restriction would <br />fall under Section 11106 of the California Penal Code and be subject to prosecution as a <br />misdemeanor. <br />This change would benefit public safety in an effort to keep handgun ammunition out of the <br />hands of criminals. It would also give law enforcement an additional investigative tool when <br />criminals buy handgun ammunition. In addition, AB 962 would hold sellers of handgun <br />ammunition accountable for the illegal sale of such ammunition to prohibited persons. <br />Therefore staff recommends that the City Council pass a Resolution in support of AB 962. <br />BACKGROUND <br />Analysis and Summary of Bill <br />Existing law requires the Department of Justice (DOJ) to maintain records pertaining to firearm <br />transactions. Assembly Bill 962 would require the DOJ to maintain additional information <br />relating to ammunition transfers and licensed handgun ammunition vendors, as specified. <br />The bill would establish a program for DOJ to license ammunition vendors and create a database <br />of all licensed vendors and sales transactions. It will require all handgun ammunition vendors in <br />California to: <br />• Acquire a Handgun Ammunition Vendor's License from the California Department of <br />Justice (DOJ). <br />• Require employees handling ammunition sales and transfers to obtain a DOJ-issued <br />Certificate of Eligibility, which includes a fingerprint and background check clearance. <br />
