CONDITIONS OF APPROVAL <br />PLN2008-00016 <br />15000 Farnsworth Street <br />D. Morrow (Applicant) and M. Ahern (Property Owner) <br />I. COMPLIANCE WITH APPROVED PLANS <br />A. The property owner and/or applicant shall comply with Exhibit A, dated June 19, <br />2008 except as hereinafter modified. (Exhibits are on file at the City of San Leandro <br />Development Services Department, 835 East 14th Street, San Leandro, California). <br />Exhibit A -Site Plan & Floor Plan <br />B. The property owner and/or applicant shall be responsible for assuring that any <br />successor in interest who assumes responsibility for the zoning approval is informed <br />of its terms and conditions. <br />IL PERMITTED USES <br />A. This is a conditional use approval that allows dance instruction to recorded music. <br />Hourly classes with approximately 10-12 students per class will be conducted <br />Monday through Friday between the hours of 3:30 p.m. and 8:30 p.m., and on <br />Saturday mornings, at 15000 Farnsworth Street; Assessor's Parcel Number 80G- <br />1372-1. <br />B. Any modification to the hours or days of operation, or relocation of the business <br />on the property or the expansion of the business shall be requested in writing to <br />the Community Development Director, who may approve the request or direct the <br />matter to the Board of Zoning Adjustments. <br />C. This approval is for dance instruction only and the space is not to be used by the <br />applicant or rented out for any other dancing activities or functions. <br />D. There shall be no sale or consumption of alcoholic beverages or food. <br />E. All doors shall be kept closed when music is being played, and signs shall be <br />posted on the doors to that effect. <br />F. The volume of the music shall not be detectable beyond the exterior boundary of the <br />property. Any complaints received by the City regarding noise from this use shall <br />be re-reviewed by the Community Development Director to provide directive for the <br />property owner or applicant to implement noise controls or direct the matter to the <br />Board of Zoning Adjustments for its consideration. <br />G. There shall be no loitering permitted on the site and the site shall be posted to <br />permit enforcement of the City ordinance prohibiting loitering by the San Leandro <br />Police Department. <br />Conditions of Approval June 19, 2008 <br />PLN2008-00016 Page 3 of 4 <br />
