Hollister <br />City Manager <br />RESOLUTION APPROVING AN AGREEMENT WITH MCIMETRO ACCESS <br />TRANSMISSION SERVICES LLC (MCI) FOR THE INSTALLATION OF FACILITIES <br />WITHIN PUBLIC RIGHT OF WAY. <br />This agreement permits MCImetro Access Transmission Services LLC (MCI) to construct and <br />maintain facilities for telecommunication services within public right of way. <br />SUMMARY AND RECOMMENDATION <br />Staff recommends adoption of a resolution approving an agreement with MCI for the installation <br />of facilities within the public right of way. <br />BACKGROUND <br />Telecommunications services within the City (and California) are offered by several companies. <br />The local telephone provider, AT&T, formerly Southern Bell Corporation (SBC) has a franchise <br />agreement with the State of California permitting it to locate transmission equipment within the <br />public right of way. Other companies, such as MCI, offer similar services but need agreements <br />with local agencies to use the right of way because they do not have franchise agreements in <br />place. <br />Analysis <br />Location of utilities within public rights of way is a long established practice. San Leandro has <br />water, electricity, gas, storm and sanitary sewers, and communications systems located within its <br />right of way. Although utilities can theoretically be buried at an unlimited depth creating <br />unlimited capacity for utilities within the right of way, there are practical limits as to how many <br />utilities can be accommodated.
