combustion engine used shall be operated on the project without said <br />muffler. The Operator shall be responsible for compliance to noise level <br />rules by any subcontractor performing work. (See attached - "City Noise <br />Regulations") . <br />1.S CONSTRUCTION EQUIPMENT: The Operator shall take all <br />necessary precautions for safe operation of equipment and the <br />protection of the public from injury and damage from such equipment. <br />The Operator shall be responsible for complying will all City, County, <br />State, and Federal guidelines concerning any construction related <br />activity throughout the property covered within this agreement. <br />1.6 INQUIRES AND COMPLAINTS: The Operator shall have designated <br />responsible management personnel, employed by the Operator, to take <br />the necessary action regarding all inquires and complaints that may be <br />received from or through the City and/or private citizens during normal <br />work hours. <br />Whenever immediate action is required to prevent impending injury, <br />death or property damage to the facilities being maintained, City may, <br />after a reasonable attempt to notify the Operator, cause such action to <br />be taken by the City work force and shall charge the full cost thereof to <br />the Operator. <br />All complaints shall be abated to the satisfaction of the City. <br />If any complaint is not abated ~~~ithin 3 working days, the City shall be <br />5 <br />
