The fiscal impact on exempting the 56'7 current businesses of this <br />type could result in an approximate $62k loss to the City. <br />City Attorney Williams expanded on her concerns explaining that the court defines family as a <br />group of people sharing a common interest, not necessarily referring to just parents, children and <br />grandparents in the traditional sense. By exempting only rentals to "Traditional" family <br />members, the exemption could be considered discriminatory. It would be difficult to craft <br />legislation that can withstand a legal challenge. Furthermore, it would be difficult for staff to <br />implement such a policy because it is hard to prove somebody is in a family. Williams pointed <br />out that some cities have legislation exempting rental properties based on the number of rental <br />units. <br />Starosciak shared her concern that the majority of complaints reflected by property owners were <br />that they were not properly informed of their business license tax obligation. Baloca shared that <br />the City did offer an amnesty program that was widely publicized. <br />Stephens shared that related parties rentals should be considered a transfer of funds between <br />family members and not be taxed. <br />Mayor recommended that the City continues its current practice of reducing penalties after <br />reviewing requests for reductions. <br />This will be brought back to the next Committee meeting along with statistics on residential <br />property rentals, number of properties discovered by MBIA and the number of waiver requests <br />received by City staff. <br />5.
