Hollister <br />City Manager <br />on Department <br />gineer ~~ <br />SUBJECT PROJECT/PROJECT DESCRIPTION: <br />RESOLUTION APPROVING AN AMENDMENT TO THE VESTING TENTATIVE MAP <br />FOR TRACT 8010, 1333 MARTINEZ STREET, TO ALLOW PHASING OF THE FINAL <br />MAPS; DEVELOPER: WESTLAKE DEVELOPMENT PARTNERS, LLC. <br />SUMMARY AND RECOMMENDATION <br />This amendment will permit the developer to file two final (tract) maps for the specified vesting <br />tentative map where each final map covers only a portion of the tentative map. The filing of <br />each final map will extend the life of the entitlements over the remaining portions of the tentative <br />map. <br />Staff recommends adoption of a resolution to permit the filing of two phased final maps for <br />Vesting Tentative Map 8010. <br />BACKGROUND <br />On March 2, 2009, the City Council approved the Vesting Tentative Map Tract 8010 for the San <br />Leandro Crossings Project, amixed-use, transit-oriented development located near downtown <br />and the San Leandro BART station. The vesting tentative map for the subject property proposes <br />400 residential condominium units on Lot One, 100 rental housing units on Lot Two, and a <br />BART parking garage on Lot Three. Lot Four is a small parcel with no proposed development. <br />These projects conform to the City's downtown transit-oriented development strategy. The <br />developer did not anticipate phasing the final map at the time the application for the tentative <br />map was made. <br />Analysis <br />The California Government code contains sections known as the Subdivision Map Act that <br />regulate the subdivision of land. Subdivisions of five or more parcels or units are accomplished <br />in two steps via a tentative map and a final map. Developers vest or lock in their entitlements by <br />
