"Subordinate Debt" means any loans, advances or indebtedness issued or incurred by <br />the Agency pursuant to Section 3.06, which are either: (a) payable from, but not secured by a <br />pledge of or lien upon, the Housing Tax Revenues; or (b) secured by a pledge of or lien upon <br />the Housing Tax Revenues which is expressly subordinate to the pledge of and lien upon the <br />Housing Tax Revenues hereunder for the security of the Bonds. <br />"Subordinate Debt Instrument" means any instrument providing for the issuance of <br />Subordinate Debt. <br />"Supplemental Indenture" means any resolution, agreement or other instrument which <br />has been duly adopted or entered into by the Agency, but only if and to the extent that such <br />Supplemental Indenture is specifically authorized hereunder. <br />"Term Bonds" means the Series 2010 Bonds maturing on September 1, 20 and that <br />portion of any other Bonds payable from mandatory sinking account payments. <br />"Trustee" means U.S. Bank National Association, as trustee hereunder, or any <br />successor thereto appointed as trustee hereunder in accordance with the provisions of Article <br />VI. <br />"West San Leandro Project Area Housing Tax Revenues" means that portion of <br />West San Leandro Project Area Tax Revenues required by Section 33334.2, 33334.3 and <br />33334.6 of the Redevelopment Law to be deposited in the Agency's Low and Moderate Income <br />Housing Fund, provided that, for so long as any Bonds or Parity Debt are outstanding, in no <br />event shall the Agency deposit less than 20% of West San Leandro Project Area Tax Revenues <br />in the Low and Moderate Income Housing Fund. <br />"West San Leandro Project Area" means the territory within the West San Leandro <br />Redevelopment Project, as described in the West San Leandro Redevelopment Plan. <br />"West San Leandro Project Area Tax Revenues" means all taxes pledged and <br />annually allocated within the Plan Limit relating to the West San Leandro Project Area, following <br />the Closing Date, and paid to the Agency with respect to the West San Leandro Project Area <br />pursuant to Article 6 of Chapter 6 (commencing with Section 33670) of the Redevelopment Law <br />and Section 16 of Article XVI of the Constitution of the State, or pursuant to other applicable <br />State laws, and as provided in the West San Leandro Redevelopment Plan, and all payments, <br />subventions and reimbursements, if any, to the Agency specifically attributable to ad valorem <br />taxes lost by reason of tax exemptions and tax rate limitations, but excluding amounts payable <br />by the State to the Agency under and pursuant to Chapter 1.5 of Part 1 of Division 4 of Title 2 <br />(commencing with Section 16110) of the California Government Code. <br />"West San Leandro Redevelopment Plan" means the redevelopment plan for the <br />West San Leandro/MacArthur Boulevard Redevelopment Project of the Agency in San Leandro, <br />California, titled "Redevelopment Plan for the West San Leandro/MacArthur Boulevard <br />Redevelopment Area" adopted and approved by Ordinance No. 99-025, adopted by the Council <br />of the City of San Leandro, California on July 19, 1999, as heretofore amended and together <br />with all amendments thereto hereafter made in accordance with the Law. <br />"West San Leandro Redevelopment Project" means the West San <br />Leandro/MacArthur Boulevard Redevelopment Project as described in the West San Leandro <br />Redevelopment Plan. <br />13 <br />
