Entering into a Development Agreement between the City and Kaiser to address <br />business terms such as the allocation of Kaiser's previous financial contributions to the <br />Marina/I-880 interchange project toward its fair-share obligations, payment of taxes <br />and fees, the vesting of entitlements and rights to build, flexibility of future phase <br />development, and the details of a Transportation Demand Management (TDM) Plan <br />for the project <br />6. Other subdivision approvals and demolition and building permits <br />Additionally, a number of other public agencies will have jurisdictional reviews and approvals <br />over certain aspects of the project. Key among these other agencies is the California Office of <br />Statewide Health Planning and Development (OSHPD), who is responsible for enforcing all <br />building standards related to construction of acute care health facilities. This includes the <br />issuance of all building and occupancy permits for the hospital and its critical support services to <br />ensure compliance with all SB 1953 requirements. <br />CONCLUSIONS /NEXT STEPS <br />Staff anticipates publication of the Draft EIR for this project by mid-January. Publication will <br />initiate a 45-day public comment period, during which a public hearing will be held to obtain <br />comments on the EIR. All written comments received and oral comments made at that hearing <br />will be responded to in a Final EIR, which will be prepared at the conclusion of the public <br />comment period. <br />Staff's focus up until this point has been to review Kaiser's proposal at a macro-level for <br />purposes of preparation of the environmental document. We are now changing the focus of our <br />review onto the specific details of the proposed Phase 1 Medical Center development plan, and <br />will continue on with that effort through the entitlement process. <br />Staff welcomes all public comment and any comments or questions that Council may have at this <br />point in the process, particularly regarding the Medical Center's Phase 1 development plan but <br />also about assumptions for the Medical Center's buildout and future buildout of the mixed-use <br />retail development. Such comments will assist us in better focusing our detailed review and to <br />bring forward more detailed responses and answers as we move forward in this process. <br />Attachments <br />Kaiser San Leandro Entitlement Drawings, including Architectural Site Plan, Floor Plans, <br />Landscape Plans, Site Circulation Plans, Site Perspectives and Conceptual Roadway <br />Improvements (on file in the City Clerk's Office). <br />
