ITEMS REMOVED FROM CONSENT CALENDAR <br /> <br />Public comments are limited to 3 minutes per speaker per item, subject to adjustment by the <br />Mayor. <br /> <br />Ordinance No. 2009-011 <br />8.C. , An Ordinance Repealing Chapter 4-12 of the San Leandro <br />Municipal Code, and Adopting a New Chapter 4-12 Prohibiting the Use of Tobacco <br />Products in or Around Workplaces, Public Places, Recreational Areas and Facilities <br />(strengthens the regulations regarding smoking in public places, places of employment, <br /> <br />recreational area and athletic facilities in the City). <br /> <br />Mr. Hollister reported on the proposed amendment to the ordinance, which would <br />remove enclosed common areas of multi- <br />place of employment where smoking would be prohibited. This change was requested <br />by the Rental Housing Owners Association (RHOA), and would be consistent with the <br />agreement made at the City Council Rules and Communications Committee with the <br />RHOA and various non-profit organizations for separate consideration of smoking <br />regulations in multi-family housing buildings. <br /> <br />Councilmember Souza expressed concern that this item was discussed at length by the <br />Rules Committee, and that the common areas of multi-family housing buildings should <br />be protected from smoking. She stated her preference that the language not be removed <br />from the ordinance. A motion to adopt the ordinance was made by Councilmember <br />Souza. <br /> <br />Vice Mayor Starosciak asked whether the ordinance proposed for adoption was the <br />same as that recommended by the Rules Committee. Staff was unsure whether it was <br />the same.
