(1049) Resolution No. 2009-168 I., Resolution Approving Program Supplement Agreement No. 016-N to Administering Agency-State Agreement No. 04-5041R to Accept Federal Funds for the Springlake Drive Road Rehabilitation, Project No. 150-38-318, Federal- Aid Project No. ESPL-5041 (034) (accepts federal funding of $350,000 to reconstruct the pavement on Springlake Drive from Washington Avenue to the Alameda County Flood Control District Channel). (2500) 9. ITEMS REMOVED FROM CONSENT CALENDAR Public comments are limited to 3 minutes per speaker per item, subject to adjustment by the Mayor. Ordinance No. 2009-011 8.C. , An Ordinance Repealing Chapter 4-12 of the San Leandro Municipal Code, and Adopting a New Chapter 4-12 Prohibiting the Use of Tobacco Products in or Around Workplaces, Public Places, Recreational Areas and Facilities (strengthens the regulations regarding smoking in public places, places of employment, recreational area and athletic facilities in the City). Mr. Hollister reported on the proposed amendment to the ordinance, which would remove enclosed common areas of multi- place of employment where smoking would be prohibited. This change was requested by the Rental Housing Owners Association (RHOA), and would be consistent with the agreement made at the City Council Rules and Communications Committee with the RHOA and various non-profit organizations for separate consideration of smoking regulations in multi-family housing buildings. Councilmember Souza expressed concern that this item was discussed at length by the Rules Committee, and that the common areas of multi-family housing buildings should be protected from smoking. She stated her preference that the language not be removed from the ordinance. A motion to adopt the ordinance was made by Councilmember Souza. Vice Mayor Starosciak asked whether the ordinance proposed for adoption was the same as that recommended by the Rules Committee. Staff was unsure whether it was the same. Vice Mayor Starosciak seconded the motion made by Councilmember Souza. A substitute motion to defer the matter to a future meeting was made by Mayor Santos. The motion died for lack of a second.
