CONDITIONS OF APPROVAL <br />PLN2009-00022- 2075 Williams Street <br />Bluewater Environmental Services, Inc. (applicant) <br />Kirsch Investments, LLC (property owner) <br />I. COMPLIANCE WITH APPROVED PLANS <br />A. The applicant shall comply with Exhibits A, B and C, dated July 16, 2009, except as <br />hereinafter modified. (Exhibits are on file at the City of San Leandro Development <br />Services Department, 835 East 14th Street, San Leandro, California). <br />Exhibit A -Existing Site Plan <br />Exhibit B -Proposed Site Plan <br />Exhibit G -Floor Plan <br />B. The property owner and/or applicant shall be responsible for assuring that any <br />successor in interest who assumes responsibility for the zoning approval is informed of <br />its terms and conditions. <br />IL PERMITTED USES <br />A. This is a conditional use approval to allow for a Light Processing Recycling Facility <br />for the sorting and recycling of construction building materials within an enclosed <br />approximately 4,800 square-foot outdoor sorting area at 2075 Williams Street; <br />Alameda County Assessor's Parcel Nos. 77A-700-6-2 and 77A-700-16-3; Bluewater <br />Environmental Services Inc. (applicant) and Kirsch Investments, LLC (property <br />owner). <br />B. The hours of operation for the recycling sorting/processing activities shall be between <br />7 a.rn. and 5 p.m. Monday through Friday, and 7 a.m. to Noon on Saturdays; the <br />business will be closed on Sundays. <br />C. In addition to compliance with all applicable regulations for business activities in the IG <br />Industrial General District, the applicant shall assure that -the recycling processing <br />activities continue to operate in compliance with the criteria and standards specific to <br />those uses as provided in Zoning Code Section 4-1646 -Recycling Facilities. <br />D. The applicant shall provide a notice when operations reach a daily tonnage that triggers <br />a requirement to obtain a Registration Solid Waste Facility Permit from the California <br />Integrated Waste Management Board. Said notice shall be provided to the Community <br />Development Director a minimum of ninety (90) days prior to reaching that capacity. <br />III. ENGINEERING & TRANSPORTATION <br />A. The proposed development shall comply with City ordinances, policies and <br />regulations. All improvements shall be in accordance with the City's Design <br />Standards, Specifications and Standard Plans unless otherwise specifically approved <br />by the City Engineer. <br />Conditions of Approval July 16, 2009 <br />PLN2009-00022 Page 3 of 10 <br />
